I don't think you having a job impacts your immigration to the US. Just make sure the person (Fiance usually) is able to meet the minimum requirements.

This is reassuring; thank you. He is substantially above the minimum requirements. It does seem odd to me that it would be a factor to consider if the beneficiary could be financially supported - unless you've amassed savings, your earnings would cease upon immigration to the US anyway.

From what I have read the beneficiary income has no affect, if the US citizen cannot meet minimum requirements then they will need a co-sponsor.  You cannot use income from beneficiary on documents to show support.

You apparently can use the income from the beneficiary.

But it would have to be A LOT!

IF BEFORE NOA#2:

You must write a letter and send it to the service center where your packet is located. I found it very difficult to find the address, and the main USCIS telephone number DOES NOT have these addresses. Just do a search for "TSC address"... Remember that there are two addresses... One for courriers and one for united states postal service.

The Letter needs to include the following:

1. THE REASON you are writing the letter

2. The full names and date of births of both the petitioner and beneficiary

3. The receipt # from your NOA#1

4. Updated address for the beneficiary

AND THEN WRAP THAT ALL UP AND SEND IT CERTIFIED MAIL

IF AFTER NOA#2:

Then your packet is likely on its way to the National Visa Center, prior to being mailed out to your beneficiary. I have read that if you are already here at this step, your beneficiary needs to go to the US EMBASSY in Colombia and update her address with the local office.

IF THE PACKAGE completes at the NVC stage, your local embassy will send the packet to the wrong/incorrect address. ( which why you need to go update it at the local embassy office )

NOTE:

Calling the National USCIS hotline wont do any good unfortunately. I called 3 times, and 2 of the 3 representatives I talked to mentioned the list above for changing address. I spent 30 minutes on the phone even talking with a supervisor because nobody knew the addresses of the service centers. Finally the supervisor put me on hold for another 30 minutes before coming back on the phone and saying sorry, I we just dont keep that information. At which time I found the address on another immigration forum.

I see, thank you, yes if they were wealthy and would not be a burden on US government I could see using savings, investments.

Actually, you cannot use the beneficiary's income as supported proof that they will not become a public charge to the U.S. Only the USC financial income and/or any US sponsor will be used to determine if they meet the poverty requirement.

 

The beneficiary can bring their money over to help the USC provide support financially, but the I-134 and I-864 is specific to the USC or US sponsor. If they allow or used the beneficiary's source of wealth/income to help with determining the financially responsibility, there would be no need to have additional sponsors.

 

Keep in mind, whether its the K1, CR1, tourist/visitor, work or student visa - or any other type of visa, there is always a person, employer or agency that is being reviewed to determine that the beneficiary will not become a public charge while being in the US, whether it's for 3 months, 6 months, or until the beneficiary naturalizes. The beneficiary has to be the financial responsibility of some type of US government agency, be it a person, job, or university - until they return back to their country or immigrate and naturalize. Even after you marry your fiancé and they get a job - the USC is still the listed financial sponsor until naturalization. So, for example, if the USC & beneficiary divorce before the beneficiary goes home or becomes a US Citizen and they have to seek out public assistance (i.e., welfare), the USC will be responsible to pay for it.

 

Not saying that will happen, I'm just pointing out the importance of this part of the process because a lot of times people do not read pass what they see.

I just need some advice on an issue my fiance and I should have researched before. Saw a post above about beneficiary unemployment and its effect on the visa, and it has panicked me somewhat.

 

We applied back in June when I was working full time in the UK (I am the beneficiary). Shortly after applying, I left my job and came to the US for the summer on a tourist visa (thinking, at that time, it would be approved by September, I would come home for a few weeks and be back again by Thanksgiving, minimizing time spent apart).

 

Obviously, that never happened, so my fiance has had to support me financially since I returned to the UK. It's no problem for us - I supported him whilst he was a student over here - and I realise that means we were very lucky in spending so much time together, when so many of you haven't been able to see your loved ones.

 

However, I read above that leaving my job months ago may have seriously impacted on our visa situation. I never even considered it. My fiance now works full-time in finance and was always going to provide an affidavit of support for me, and we considered getting one from his Mom too.

 

Does anybody know what steps I need to take to mitigate the impact my decision to quit might have on my visa? How should my fiance be informing USCIS, and is there anything else I can do in the meantime, aside from getting a short term job (which I will obviously now consider!)?

 

Thanks for the anticipated help. Feel a bit of an idiot that neither of us considered the consequences - just assumed it didn't really matter what I earned because of the affidavit and the fact I'd need to quit my job to come to the US anyway! We treat our money/income as one and the same. You live and learn.

I am in the same position as you. I quit my job because I thought by now I would be over and my contract was ending. As long as your fiancé (the petitioner) meets the financial requirements you are okay to be unemployed. Same as you it has thankfully allowed me to travel a lot to the US, and the only difficulty I have faced is proving ties to the UK... many people use employment status for this! There really is no consequence of not having a job as the beneficiary.

Thanks for the help everybody. Indeed, being unemployed has prompted some longer-than-usual grilling at the border, but I've gotten through without too much hassle, even with the K-1 pending. Reassuring to know it shouldn't impact anything else.

Honestly, you should enjoy it!

 

Spend time with people that you may not see as much after you move.

 

Take the time to chill and do things that you've never really had time for before.


I wish I was brave enough to quit and do stuff around my home city and with family before I have to move permanently.

Well... Balls.

So, the Poo to my Sheen (hehehe geddit? Pusheen? I laughed for a good 5 minutes to myself on the bus 😹😹😿 this is where I'm at mentally) was let go from his job due to cuts (but hired someone else for less pay, very noble for a Christian company 😒). We already send a letter from his place of employment stating his position and income. Think we put a lot of things in extra that were not necessary at that stage, to be honest. But, it's there.

 

He has his tax returns for the past 3 years and is currently on unemployment for the time being. Haven't had our NOA2 and I don't think we will for a while (June 30th).

I'm pulling my hair out wondering what the hell to do. I'm working all hours the day gives me, putting all I can away. Not handed in my notice yet either.

Dealt with enough delays already. I should be an early May filer. 😿

 

What do we do now? Is this where we ask someone else to sponsor me? Or will his method of income be sufficient?

Well shoot.  Carl received his letter for more evidence.  All they want is a 2x2 passport style picture.  Really, the copy of the ACTUAL passport and photo wasn't good enough?  Guess it's a trip to CVS tonight to get a photo and mail that back in.  Hoping for an approval soon after they receive it.

I am June 5th and as I watched folks from days like the 7th and 12th pass me by, I became very discouraged, sad, angry, you name it.

 

Decided, F this!!!!,  I’m going out and gonna treat myself to a nice meal and enjoy the day for what it is.

 

We got approved about 30 minutes later.

 

I now understand why the folks approved before said, hang in there, and I remember rolling my eyes thinking, of course you can say that, you’re already approved!!

 

Well, now it’s me saying to you, “YOU'VE ALL GOT THIS.

 

And I really do mean it, have faith.

 

It will happen.

 

 

 

 

Congrats, and life DOES work like this. You always get what you expect when you least expect it.
