i've been reading through the feed and noticed a lot of you getting visa approved after interview. Just want to say CONGRATULATIONS !!!! I hope that us waiting will be able to be as happy as yall really soon (crossing fingers)

I'm happy that things are moving right along for you and your fiancé and soon you two will be together.

 

For me....things are still the way they are. I called USCIS yesterday to be told the same lingo...my case as of 2/26 has been assigned to an officer but they cannot give me a timeframe on when I hear anything back. I was told this same rhetoric 3 weeks ago that my case was assigned to an officer on 2/5 but they couldn't give me a timeframe. I'm 18 days a way from being 10 months in waiting for a NOA2, RFE, or NOID (if that's where this is leading to at this point...who the heck knows anymore). Either way, I have a lot of things to consider in regards to whether if this is fair to my fiancé to keep going on like this.

 

Every day that passes by is a day taken away from us being able to start our family. And with my age (38) and previous medical history when I was pregnant with my son, the deck gets stack higher and higher against me. Reni (he's 30 going on 31 in September) has no children of his own, and is beyond ready to have his first child, but I am choosing to wait to at least he gets here because I do not want to be apart from him while going through a pregnancy; especially since if he gets an interview past my time where I can fly to attend his interview, that in itself adds to more stress. But at this point, what kind of person would I be by not honoring his wish and God Forbid if and when he ever gets here, what happens if I just can't have any children....when he could have already moved on to do so with someone else? This is just SOME of the pressure I have been dealing with. I want to buy a house this year, but can't because I'm stuck waiting for this process to bring me whatever resolve. I want to go back to get my Master's Degree, but can't because I'm stuck waiting for this process. And so many other things but yet, my life and his life is stuck!!!!!!

 

The idea of Reni and I not being together leaves me completely empty inside and it's an unbearable pain but at Day 282, with no explanation as to why, who, when, where or freaking how is something I'm beyond tired of dealing with. This process has left me, anti-social, depressed, stressed lack of sleep and now I'm losing weight again because I have no desire to eat. And being told by USCIS every single time that they cannot provide a timeframe on when my case will be adjudicated leaves me to keep asking myself over and over "how much more and how much longer can I really go through this?"

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Thank you....I really hope you're right. I'm literally sitting in tears right now, crying at desk at work. Crying for me, has become a normal part of my daily routine. I really feel like I'm being punished and don't even know what for!

 

Added: I just saw in your timeline you got a RFE...congrats to you!!! A step closer you both are!

For your RFE...did you get a email/text or USCIS case tracker notification or did it just show up in your mail?

By the time you're reading this I hope you are in America! :) Congratulations! Omedeto and yokoso!

We weren't asked to bring a letter pack either. In fact, the interviewer was supposed to give us a letter pack to mail back in our supporting documents but they didn't. We called the embassy and they said "it is up to the interviewer whether or not to give the envelope". (Which my fiance just thinks is code for, they forgot).

 

They kept our passport, so I thought they would just send our passport back to us when we are *crosses fingers* approved. I think it says that on the website talking about how to deal with a 221-g.

We sent in our additional documents on Wednesday, JST, and it should be there Thursday morning JST. Maybe I'll have my fiance call on Friday afternoon to see if we can get any more information. 

 

Oh! And @Minori, my lawyer told me this, but be careful when applying for AOS and Green Card. Since we got "221-g" it is technically a denial of a visa. This means when there is a question for "have you ever been denied a visa" we have to say yes and then give the details of what it was. It shouldn't cause problems, but we are required to disclose it.

I got an email, text and notice in the app.  It showed up a few days later in the mail.

Can you clarify the "denied" disclosure for the 221-g?  What were you issued a 221-g for?  We are currently in AP, awaiting results from the DS-5535 screening.

We got 221-g notice, the first sentence of the paper being 

"The office regrets to inform you that your visa application is refused because you have been found ineligible to receive a visa under the following section(s) of the Immigraion and Nationality Act.

[x] Section 221(g) for noncompliance with the INA's requirements. Please mail in the following items along with your passport(s) at the above address to seek reconsideration. Submission of documents does not guarantee visa approval."

 

We did not have an original copy of his birth certificate (family register in Japan) at time of the interview. 

 

This is what people normally call administrative processing, but because it is classified as a "denial", it needs to be disclosed when being asked if you've ever been refused a visa, is what my immigration lawyer told me. 

 

Please let me know if you've heard something else! I'm not a lawyer myself so I can't say anything with 100% certainty.

I have never heard of this, but I haven't read that much yet about AOS and I'm not a lawyer.  I hate that the 221-g starts with "the office regrets to inform you that your visa application is refused..." its so harsh, when in reality it's not actually denied.

 

I'll have to do more research into the AP/denial disclosure.  Ours is due to new processing so there isn't much documented on it.

It is so harsh ): It just makes the whole situation worse, especially because, like you said, that really isn't the case.
