Hello, I hope I ask this in a clear manner. I was ask this a few days ago and cant find any information on it. thought I'd try here.

A friend that is a Venezuelan is a permanent resident of Panama and living there now. He has been there 2 years. He has a Venezuelan passport that is now expired.

He went to the embassy in panama to renew his passport last October after having to wait for the appointment 8 months. He was told because of the current situation in Venezuela he would have to wait at least a year to receive the new passport.
He has a valid visa to the US in his expired passport, which is still in his possession. That visa was issued while he lived in Venezuela in 2014. He has not yet traveled here on that visa. After receiving it the situation changed and he was not able to use it for the original travel plans.
The questions are......
Does anyone here know if he can now get a Panamanian passport...
And If he does, can he travel to the US with that passport and the visa in his expired Venezuelan passport?

I believe only citizens of a country can get a passport for the country. A simple Google search states you need to be a permanent resident for at least 5 years in Panama to qualify to become a citizen.

  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

As far as I know, the rules traveling with valid visa in expired passport plus new passport require both passports to be from the same country. 

But it’s moot anyway as he’s only a PR of Panama, not a citizen, so wouldn’t be able to get a Panamanian passport.

Not necessarily true.  I’ve travelled with visas in expired passports.  If the visa hasn’t expired you can use it.

My old passport has already expired. My visa to travel to the United States is still valid but in my expired passport. Do I need to apply for a new visa with my new passport? 
 

No. If your visa is still valid you can travel to the United States with your two passports, as long as the visa is valid, not damaged, and is the appropriate type of visa required for your principal purpose of travel. (Example: tourist visa, when your principal purpose of travel is tourism). Both passports (the valid and the expired one with the visa) should be from the same country and type (Example: both Uruguayan regular passports, both official passports, etc.). When you arrive at the U.S. port-of-entry (POE, generally an airport or land border) the Customs and Border Protection Immigration Officer will check your visa in the old passport and if s/he decides to admit you into the United States they will stamp your new passport with an admission stamp along with the annotation "VIOPP" (visa in other passport). Do not try to remove the visa from your old passport and stick it into the new valid passport. If you do so, your visa will no longer be valid.

Thanks, this was what I thought also but because of the current problems in Venezuela it is almost impossible for them to get new passports. and the us is certainly aware of that. I was hoping to give him better news.

His visa is valid until 2024.

Well, unfortunately the rules seem to be that if he is eligible to get another country’s passport he’ll need another visa. If he has no other nationality currently he seems kind of stuck...?  Unpleasant situation.

They don't recognize the expired passport but only an unexpired valid visa that is attached to an expired passport.

I'm assuming that the embassy will need to put some kind of stamp or something in the passport that officially extends the expiry date by 2 years.  It's not up to US CBP to keep up to date with internal policies of other countries and I'd be pretty sure that if presented with what seems to be an expired passport they'd refuse entry (as would an airline refuse boarding if he tries to fly with it). One has to assume there is something official that will extend the expiry date.

Your friend have to wait to renew his passport in the Venezuelan embassy in Panama, because that passport extention was only a news more than a fact.

No one has been able to renew his passport yet base on that extention.

 

Im a permanent resident in Panama too and he can not get a Panamanian passport until he get the citizenship.
