Hi everyone,

What happens to HCMC when they delay my case one more time?? (K-1)

In the first Blue, they asked for more financial documents (212 (a) 4) and never mention anything else beside more income needed.

But, in the 2nd Blue, (just got it yesterday), after resubmitted all requested documents, they turned the table around, asked for more evidences of our relationship (221g).

Why they did not mention it in the 1st Blue, but now? Do they do it intentionally? What should we do now? Of course I can provide more evidences like photos, emails, phone calls,.... But, is it enough for them, or they gonna ask something else, again? Thanks for your opinions.

My fiancee and I have been dealing with this for years. You give them the documents they request and they turn around with another blue slip. Sometimes they are legitimate reasons, sometimes the document has been submitted and they didn't take the time to find it in the file, and sometimes they give reasons that are so far out it's obvious they are stalling.

Recently other memebers of the VJ Vietnam family had their cases resolved under circumstances where the real reasons for delay were hidden from them. In one case it had to do with a third party that was not even involved in the case. So you can't really count on the Consulate being honest with you at all times. From my experience, the decisions made by the reviewing Consular officer are very arbitrary and the explanations are often absent or incomplete.

The best you can do is keep submitting the evidences they request and narrow down their excuses for delaying your case. When you do submit addtional evidence, have your congressman follow up the case to make sure it is reviewed in a timely fashion. The worst thing is for your file to become stagnant.

I have found attorneys(at least stateside) to be absolutely worthless in this situation. Sure, they will do the paperwork, but as soon as delays arise they head for the hills. As long as HCMC has your file, it's out of reach of any kind of judicial oversight or action. Only if it is outright denied can the attorneys really jump into action.

It's a very tough thing to go through for both of you. It seems to make your lives most uncertain. As hard as it is to do, you need to separate the existance of your relationship from the visa itself. Because her visa case is stalled does not mean your relationship is stalled. Continue to grow your relationship as best you can. Don't let the Consulate define the status of your relationship or the terms of your life. Continue to document and build your case and be persistant. :)

You have some good advice already : Here's my insight

What I have observed is that from the forums is that interviews that get stuck in stage 1 ( are the documents in order - 1-234, etc ) may not get the 2nd part done ( either cursory , or in detail ) at stage 2 .... ( relationship interview ). Which seems to describe what happened to you.

The best think you can do is simply go over what evidence you have, add a cover letter to address the blue slip. You have a second chance to organize you evidence and make it more compelling that the first time. ( We did that ).

Nobody can guarantee what will happen in your case, I just know we were blessed to have the paperwork reviewed when she returned with the package and got a pink slip. Keep trying for the pink. :thumbs:
