Hello all, 

As with most of us I am trying to navigate this  difficult path to get my Fiance (f, australia) over here to the States with me (m, Claifornia). My first (of what I'm sure will be many questions) is when do I submit photographic evidence? Do I send pictures along with the I-129f forms? Or just the forms and the cover letter in that package?

Yes, you need to submit photographic evidence (pictures of you and your fiance together, passport stamps, receipts, and many more things that proof you guys have been meet within 2 years before filing the petition and proof of ongoing relationship) together with I-129F forms.

There's 2 different aspects here...

 

1) Proof of having met at least once within 2 years. This is a requirement for the I-129F. Photos are secondary evidence since putting a firm date/location is quite difficult. But photos are good evidence to corroborate other evidence. Passport stamps, boarding passes, receipts, itineraries, etc. are good to include.

 

2) Evidence of a bona fide relationship. This is not required nor evidences reviewed for the I-129F. But providing it beforehand provides an opportunity for the CO at the embassy to see it before the actual interview. Australia is low fraud so it's probably not needed to "front load" evidence with the I-129F, but it wouldn't hurt to provide some evidence either. More evidence should still be presented at the embassy interview later in either case.

I would like to ask regarding point No.2, I did read about evidence of a bona fide relationship is no need during I-129F. However I did read about the Consulate Officer (CO) will review our I-129F package and they basically already decide whether they want to approve or not. And some of consulate officer not even want/asking to see evidence that the beneficiary bring during the interview. Is it  more safer if we front load the bona fide evidence too?

The answer to that will depend on who you ask and the circumstances of thee individuals. IMO, there's no good generic answer.

 

I'm one that believes less is more, so you make a bigger impact with just giving them what they want, when they want it. With the embassy my then-fiancee went through, front-loading wasn't needed so we didn't do so. If somebody was going through a high fraud embassy, frontloading is highly suggested (or worse) as it is believed the COs review and form an initial opinion before the actual interview.

 

That said, if in doubt then there's little risk in sending anything. Just know anything you send can also be used against you...so just be prudent with sending things that are solely helpful (i.e. sending 500 pages of chat logs will never fully be read but could be cherry-picked and asked about).

She's coming to the US from Australia, so I don't think that would be considered a High-fraud country, but I'll keep that in mind. Thank you!
