My wife came to USA in June 2016 on K1 visa. We married September 2016. She received GC October 2017. She has 2 daughters(23yo and 25yo) And 1 granddaughter(4yo daughter of the 25yo)

 

Is it better for her to file I-130 for her daughters and granddaughter as a GC holder? Or wait until she is US citizen to file I-130?

if they are single she should start right away since the wait is long then she can change her status if she wants to,

 

whatever the category that has less waiting time.

 

now if they are married, then she will have to wait until she is a USC

 

they can't marry unless she is a USC

They are not married. They are single. 

I posted this question because everything I read online and heard from friend was to start process as soon as she got GC. 

But, the USCIS officer that interviewed us for her GC told us that she should wait until she was a citizen to petition. He said it would be shorter wait time. 

But looking at visa bulletins from USCIS, it’s a long wait either way. 

This website was invaluable to me in my K1 Visa quest.

Sometimes it can be longer as a USC, but if you file as a LPR you can opt to keep your PD.

She can start the petition as soon as she enters the US and the visa in her passport is endorsed, as it can be used as proof that she is a LPR until her green card is received.  There will fall in the F2B category which is unmarried children over 21 of LPRs.  They must remain unmarried though and can only get married if there mother become a citizen, if they marry before the petition is void and she will need to begin a new petition.  The current wait time from petition to interview is 7-8 years for F2B should they get married after she becomes a citizen, more years would be added.

 

My mother petitioned for my two siblings and I in 2007, in 2009 and 2011 respectively my siblings got married.  In 2012 my mother become a citizen but my siblings petition was voided as they got married before she became a citizen.

 

My Journey

Priority Date: July 24, 2007 (EAC)

AOS fee paid: February 2013

Request embassy change: May 2013

Son born: September 2013 (added to petition March 2014)

Interview: March 17, 2015 (Joint sponsor needed)

Joint sponsor documents submitted: April 27, 2015

Visas approved and issued: April 30, 2015. Had to return to embassy to do oath for son :)

Visa in hand: May 5, 2015 (two working days after issued)

IV fees paid: August 10, 2015

POE: JFK - September 10, 2015 (one day before visa expiry date - No hassle)

Returned to Barbados: September 28, 2015

Green cards: October 5, 2015 :dancing:

Entered US permanently: March 22, 2016

Applied for SSNs: March 28, 2016 (didn't tick box on DS-260)

SSN received: April 4, 2016;

Learner's permit: April 7, 2016 (in NY you also have to do 5-hour class);

Driver's License: July 13, 2016 (on first try) :dancing:

Husband's Journey (F2A)

Married: September 2015

I-130 sent: October 8, 2015 (via USPS)

Priority date: October 9, 2015 (WAC)

Petition approved: March 8, 2016 (5 months to the date of receipt) :)

NVC Welcome Letter: May 13, 2016
AOS documents sent: August 8, 2016
Case complete: September 14, 2016 (the waiting continues

Interview:  October 5, 2017 (Approved - Issued following day :))

Visa in hand:  October 12, 2017

POE:  October 13, 2017

Green card:

SSN:
