Hello there,

I'm at the stage where I am filling in the I-864. I'm not 100% sure how to go about filling this with co-sponsors so I thought to ask for some help here.

The details:

I have had $0 income for the last 2 years(taxes filed but with 0$ also) as my wife and I have been traveling/volunteering overseas.

My parents will be co-sponsoring my spouse.

I am currently living with my spouse in Canada but my mailing address is the same as my parents.

How would I go about filing this?

Would I file an I-864 individually with 0$?

Will each parent fill in one also? They files their taxes together, would they only need to fill one?

Thanks in advance!

You would file an I-864 and provide your 2016 tax return. Your joint sponsor would also file an I-864 and provide their 2016 (and optionally 2015 and 2014) tax returns + evidence of their income (pay stubs & employment letter preferred if a wage earner). They should also provide evidence that they are a USC or LPR in the US.

Only one parent would be a joint sponsor. The other can (should) complete an I-864A to combine their income with the joint sponsor, and also provide the same type of evidences + tax return(s).

A bit confused about what to choose on the I-864a form for my mother.

Quote

I am the intending immigrant and also the sponsor's

spouse.

I am the intending immigrant and also a member of

the sponsor's household.

I am not the intending immigrant. I am the sponsor's

household member. I am related to the sponsor as

his/her:

Spouse

Son or daughter (at least 18 years of age)

Parent

Brother or sister

Other dependent (Specify)

Which one would my mother choose from the above?

Does the "I am the sponsor's household member" apply to her? Does that not imply that she is a member of my household and not a member of the co-sponsor?

The mother would be the spouse of the sponsor (father) for which she is filing the I-864A.

If i did this, would they not infer that she is the spouse of the sponsor(Me) rather than the spouse of the joint sponsor(My father)?

And for my father, would he be?

  • I am the only joint sponsor.

  • I am the __first __second of two joint sponsors.

Thanks in advance for the help. Just trying to make sure there are no complications that would result to an RFE.

Let me see if I can clarify this...

You would be the primary sponsor. You must submit an I-864.

Your father would be a joint sponsor. He would submit an I-864. His wife would complete an I-864A as a household member of the joint sponsor for his I-864.

The terminology may be confusion here as it only says "sponsor". Both the primary and joint sponsors are sponsors. The I-864A is filed in conjunction with the I-864 from any sponsor.
