This is all far too confusing for me, i'm really struggling with this. I am from England and my fiancé is american. 

I understand he (the US citizen) will need to file for the K-1 visa, correct? 

So im looking at the step by step guide on the site:

 

Forms Needed to File for a K-1 Fiancé Visa:

1. I-129F
2. G-1145 (optional) 

 

Does that mean there is only 1 form to fill in?

 

because then, i click on the  I-129F link and then more forms come up:

 

    I-129F, Petition for Alien Fiance(e) [USCIS Instructions](also used in K3 apps): This form is used to petition to bring your fiance(e) and that person's children to the United States for marriage to you or to bring your spouse and that person's children (K-3 and K-4 visas, respectively) to the United States to complete processing for permanent resident status (under the LIFE Act and Amendments of 2000); please see section 12 of the Instructions to the form.
    I-134, Affidavit of Support: To file a promise with the Bureau to support an alien entering the United States and that the alien will not become a public charge. A separate affidavit must be filed by the sponsor for each person.
    G-325A, Biographic Information: To provide biographic information on an alien. You file this form only as instructed on another Immigration application or petition.
    DS-160, Online Nonimmigrant Visa Application: This is an online form which the embassy requires to obtain your visa.
    DS-156K, Non-Immigrant Fiance(e) Visa Application: This is only needed (and should be provided) by the US Embassy issuing the Visa.
    DS-156, Non-Immigrant Visa Application: Only needed at once you reach the US Embassy handling the Visa. Should also be provided by them.
    DS-230, Application for Immigrant Visa and Alien Registration: Only needed by US Embassy handling the Visa. Should be provided by them also.

 

 

So my question is what exactly does he have to fill in and what do i fill in?

Also I've seen website that say they can help by paying them to do it? Would that be worth it? Will it make this less stressful?

I'm sorry i'm just struggling to get my head round this.

There are several stages to this process, and for each stage there are forms to fill out. Your USC fiancé needs to first file a petition, which is the i-129f and all the other forms that go along with that petition. Now, we filed earlier this year so it is my understand that the petition forms have now changed to include all the biographical questions in the same form. Take a look at this link and it will tell you step by step what you need to do.  But your first step is your petition, and after you mail that out to USCIS there is a long wait until the next step, so my thoughts to you is do the petition and send that out, and after you receive confirmation from USCIS that they have received it and it’s processing then you worry about the rest of the process so that you are not so overwhelmed.

These are the documents that you need:

 

1.) https://www.uscis.gov/i-129f   (be sure to follow all the instructions on the form)

 

2.) Letter of Intent to marry for both petitioner and beneficiary

 

3.) A letter stating how you met your fiance/ fiancee and how the relationship progress to engagement

 

4.) Proof of meeting within 2 years  ( ex. Photos which also includes the dates when it was taken, plane tickets, passport stamps, screen shots of call logs and messages, etc.)

 

5.) 1 pc. US passport size colored photos (GLOSSY PAPER) of both petitioner and beneficiary.

Before rushing into paperwork, I would also strongly advise that you research the full implications if a K-1 visa and compare it with the CR-1 spouse visa. The CR-1 is for people who are already married (you can get married on a visit to him in the US, or anywhere else of your choosing) and then you would each return to your respective homes, complete the visa procedure and then you would move. 

 

From one Brit to another, I can't see any advantage to a K-1 visa for a working person from a VWP country. People are often tempted by the belief that the K-1 is quicker but even that's not always true anymore. The K-1 is more expensive also. Take some time to read the comparisons on here. And don't just focus on the processing time. This is a step that will affect every day of the rest of your life. The quickest solution isn't always the best solution.

I cannot tell you that because like I mentioned before the forms changed after we filed ours. If you submit an older version you will have to start over. Check the travel state link I first gave you. It tells you all the steps.

I-129F + all supporting documents now. See the guide: http://www.visajourney.com/content/k1guide

G-1145 is optional but recommended (and only takes seconds to fill out).

A cover letter should be provided, and proper payment must be included (on top of everything else).

ETA: ~5-6 months for I-129F approval

 

After the I-129F is approved and the case goes through NVC and to the embassy, then the actual K-1 visa application process begins.

The exact forms and order/timeline vary from embassy to embassy. A DS-160 will need to be completed, as well as a medical exam, and police certificates will be needed. Then they will interview.

ETA: ~7-9 months from I-129F filing to visa interview

 

After arrival in the US on the K-1 visa, you would marry (within 90 days!!!) then file for AOS. Lots more forms again, and a $1225 filing fee.

The only forms you need to apply for K-1 are:  I-129f and G-1145.

 

But with the forms you have to include:

- Cover letter (what you are applying for and to whom, nice if it had info about all your attachments)

- Statement of the intent to marry your fiancé within 90 days after you enter US (dated and signed by you) 

- Payment confirmation (I used money order)

- Proofs of meeting at least once during last 2 years (internary, pictures, account bills for hotel etc good if matching with the photos, we also included my ring bill lol)

- 2x2 inch passport style photos of you and your fiancé signed on the back 

- American citizen birth certificate or all passport pages scanned

- if divorced, a divorce decree 

 

So yes so far 2 forms only plus listed attachments. Instructions are for petitioner to fill I-129f properly but you don’t include them in the petition, its just a guideline how to fill the form and what to include. I-134 is needed for the interview so your fiancé can send you that  after petition is aproved and ready to send to you countey for further processing.

 

I know it seems super complicated at the beggning but the more guides and information you read they easier it goes.

I know it looks really daunting at first. I had been researching the K1 process for months before being able to make heads or tails of it and it still sometimes confuses me. We are now in the process of getting everything filled out to file the petition in December (ITS ALREADY DECEMBER!!!!!!! 12 more days :wub:). The best advice I can give you is to start reading the VisaJourney guide thoroughly. Then read it again. Then one by one take the forms mentioned in the VisaJourney guide and read them including the instruction page on how to fill them out. Make notes of what form does what cause all those numbers can be confusing. Then start making a list for yourself of all the things you will need to file the petition (birthcertificate, divorcepapers, pictures, boarding passes, courtfiles, ect), who needs to do them (you or the USC) and how long it will take to get those documents. Then go through the VJ-guide, the forms and instruction forms again to see if you missed anything. By that time you should have a pretty good understanding of what goes where and when.

 

Keep in mind, there's three stages:

- the petition so the alien fiancé(e) is allowed to apply for a k1-visa:  I-129F form done by the USC

- the actual visa application: the interview at the embassy done by the foreign fiancé(e)

- filing for adjustment of status after marriage done by the foreign spouse in the US

I had a freak out today about how stressful this was (there were tears involved) and started talking about hiring an attorney or using them websites to try and make this easier.
