Hi vjers,

I would like to petition both my mom and daughter. 

My daughter is a minor. 10years old. 

I am a US Citizen. 

 

Please advise how would i file petition. Do i petition jointly? Is the fee the same for both? Or is there a discount for filing jointly?

 

how long is the estimated wait? I am located in guam. 

 

 

Your advises is greatly appreciated. TIA.

For my mom, visa. But for my daughter, isnt she supposed to get citizenship. Because i am USC and she’s minor. (At least that’s how it was on my case when my dad petitioned me)

are you a us born citizen or you naturalized?

 

did you qualify to automatically pass your citizenship to her? if so, why didn't you do it when she was born? if you qualify, you wouldn't need to petition for her, but file the CRBA, Consular report of birth abroad

 

if you didn't qualify for CRBA, then you will have to file for her, a regular petition, and when she enters the country, she will automatically derive your citizenship

I Have a CRBA. I wasn’t a USC yet when my daughter was born.

so then you need to file for her separately

 

once she enters she will derive your citizenship, for the affidavit of support you need to send the i864W, the waiver because she will derive citizenship once she enters the country

How can both of the parts of this sentence be true?  A CRBA documents that a person (you) was a US citizen from the time of their birth.  So, you had to have been a citizen at the time of your daughter's birth.  You may well have not had the required US physical presence (5 years, 2 of which were after you were 14) to transmit US cituzenship to your daughter, but that's different than what you wrote.

I was not a US citizen at time of birth. My father petitioned me 7 years ago to be exact and that’s how i got my citizenship.

Then you don't have a CRBA, you have a certificate of citizenship or a naturalization certificate.  This is an important distinction for getting the correct advice here.  You will need to file an I-130 for your daughter.  Once she is admitted to the US, as long as she is under 18, she will automatically become a US citizen under the Child Citizenship Act.
