Not getting any information since we sent our I-130

Hello everyone,

 

My husband sent our I-130 package on July 10 th ,  we read all the information provided on this forums, also consulted someone to help us review everything was ok and sent the package. Since the beginning we have been having nothing more than problems, we never got a notification  on the mail like we were supposed to, after 2 months we started to get worried so my husband called the USCIS, the lady that spoke to him told him it was weird we never got our case number because on her system it showed they've sent it already that she didn't know what the mistake was, we thought it was the mail but all the information was correct, she said she was going to make sure everything was sent again and gave us a number to check on their website, the number only worked that day it said they were processing our stuff,  after that day it never worked again... everytime we try it says its invalid. My husband decided to wait again to see if he was going to get the mail the lady told him he would, never got it

He called again on October, same answer "we already sent a package",  verified the mail adress with them, all was good, told us to wait a couple days to get it and to check at their website again on that week because they were doing maintenance, neither worked. We called them again on November  6th  the person that talked to my husband told them " we sent the package yesterday, it's an RFE, you should get it in a couple days" It's december and nothing....

 

We are a bit concerned, they have told us there is nothing wrong with the information we provided, the mail adress is fine,  there is no way for us to know the status or what we need hence we aren't getting anything in the mail and the website doesn't work for us. 

Is this a normal situation ? Or should we be getting a lawyer?
We know there is a due date on the RFE ,  we are feeling hands tied because we call them and they all tell us the same, we've explained we aren't getting anything and they tell us they don't know why but that we will next time and next time never comes . We've never done this and I don't know how smart it is to keep waiting  or if this is normal....

I'd really appreciate your comments.

I would call again and ask to speak to a Tier 2 rep. We never got the receipt notification in the mail and USCIS claims to have sent it three times. The initial receipt is not important. You will never need it except to add to your scrapbook to show the grandchildren one day. So although we never received ours, it wasn't a problem. 

 

But the RFE is serious business. If you don't respond to the RFE before the given deadline, your petition will be denied. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

We will try that again next week, I figured not getting the notification wasn't a big deal but since they told us it's an RFE  we are getting worried it's been almost a month and I think it's weird it's taking so long since they said they've sent it already.

 

The due dates on the RFE change depending on what they are asking? 
I'm sorry I'm bitting my finger nails over here because I don't know how do they expect us to send the information they are requesting if we don't know what it is that they need yet : (.

You can also setup an account with USPS to monitor all mails coming to your house which will be a good idea for you case. Hopefully, somebody is not messing with your mail. Good Luck

My case is different but maybe family of this!

I received 10 days after sending it the i-130 the NOA1 via E-mail, text message and Hard Copy thru post mail, but.....

Our LIN number never worked, my wife called last week and talked to a Tier 2 rep and told her that, don´t worry about it, the case hasn´t been put in the system yer, but everything is fine! that we should check this month again and should be working!

But if there is a RFE, worry about it! and Call them and insist!!!!! If you don´t response to the RFE you will lose the case and have to start all over again!

February 2016: We met in our jobs.

May 31 2016: We became a couple. :dancing:

August 16 2016: Engaged.

October 20 2016: ¡OUR WEDDING! Wooohooooo !!!!:dancing::dancing::dancing::wub:  :wub: :wub: 

CR-1 Visa Journey ... Service Center: Nebraska. Embassy: Bogotá , Colombia.

Monday, August 21 2017 (Day 1) :  I - 130 sent. 

Monday, August 28 2017 (Day 7) : NOA(Received via e-mail and SMS).  :dance:

Tuesday, September 05 2017 (Day 15) NOA(hard copy I-797 received thru post mail) (PD Aug 24 2017).

Tuesday, March 13 2018 (Day 201) : USCIS issues RFE to our case . (Case opended at least) .:dance: 

Saturday, March 17 2018 (Day 205) : USCIS RFE  arrived via post mail.

Monday, March 19 2018 (Day 207) : USCIS RFE ´s answer was sent via post mail to NSC .

Thursday, March 22 2018 (Day 210) : Online Case Status changed to RFE´s answer was received .

Monday, April 2 2018 (Day 221) : ¡Approved! Online Case Status now shows Case was sent to Department of State.:dance::dancing:

 

(NVC Stage) :

Wednesday, April 4 2018 (Day 223) : Case Received.

Tuesday, June 5 2018 (Day 285): Case Number assigned, welcome letter received,invoice number received, DS261 filed.

Thursday, June 7 2018 (Day 287): AOS fee paid, waiting IV package fee to be unlocked to pay it.   

Thursday, June 14 2018 (Day 294): DS-261 checked and received letter, IV package fee now unlocked. 

Friday, June 15 2018 (Day 295) : IV fee paid, waiting DS-260 to be unlocked to fill it online. 

Monday, June 18 2018 (Day 298) : Full Package sent to NVC via post mail

Check with the post office and perhaps your post man too. May be tell the post man that you have noticed that you have not been receiving some of your mail. May be the post man is mixing up the mail. Check with the post office to see if they have anything to say (I would talk to a manager or someone if available rather than talking to the people working up front at the post office). 

 

If there are no issues on the post office side, then I would contact USCIS and explain to them about your situation. Do you have a copy of your application? If so, then check to make sure the address you put on the form is accurate.

My husband called them again , this time he spoke to a T2 representative,  this person told him it was a mistake on their part but he didn't know what it was  so he asked for a day or two to figure it out, next day my husband got an email from them  with some sort of "apology" saying it was a mistake on their part and that they were making sure he'd get the mail this time, so here we are waiting on them again, the only thing the T2 representative was able to tell us is that the RFE has a 6 month  time limit and on the email they said they'd be reseting the time for the RFE so we wouldn't be affected.

 

I just hope this time we get it

Good News, my advise, try to resolve the RFE and send them the required document ASAP! RFE delays the process 1-2 months, the good new is that the RFE means that your case is on TOP and they reviewed, even when a RFE was send!
