I really am not sure where to go for the answer to this.  But this forum was really helpful years back so hoping someone ca help.

 

I am British, married a American, had a child in the USA.   We lived with said child in UK as he is duel national.  6 years ago we moved back to the USA.  I am looking to move back to the UK and taking my job with me, having accommodation and also financial means. 

My son would like to move back (he is duel) and wants to bring his fiancee with him who is a US citizen.  He and she currently lives in the US. They are engaged and have some evidence of their relationship.    What is the easiest and best way to do this?

July 2010 - Hubby and our children moved back to USA (for work etc)

Nov 2010 - Visited for 3 weeks (it hurts like mad to be away from them)

June 2011 - visited for 4 weeks

26th June 2011 -I-130 Express Mail to Chicago

28th June 2011- I-130 Chicago signed for package

12th July - Returned to UK..

29th June 2011 - USCIS informed me Noa1 mailed on 29th June

2nd July 2011 - Touched

8th August 2011 - Expedite approved

12th August 2011 - Touched

12th August 2011 - The dreaded RFE!

9th September 2011 - RFE received by CSC - being reviewed!

13th September 2011 - USCIS approved

19th September 2011 - NVC received file.

4th October 2011 - NVC # assigned, emailed dob amendment email (amended now), emailed DS-3032, Logged into payment portal (not invoiced), booked medical - 20th October

5th October 2011 - Emailed expedite

6th October 2011 - 2 emails from NVC (expedite and ds-3032 responses)

- SIF at payment portal.

7th October 2011 - expedite approved

12th October 2011 - case left NVC (nice birthday present!)

13th October 2001 - case arrived in UK

20th October 2011 - Medical - passed

24th October 2011 - DS-230 & DS-2001 received by Embassy

3rd November 2011 - interview - approved

4th November 2011 - text message from courier, saying they are delivering on Monday

7th November 2011 - Visa received

10th November 2011 - POE - LA

Well he could sponsor her as a wife of Finacee but my forst question is whether he has the money or the job earnings to do so.

Thanks for moving the post Ontarkie, and for your response Boiler.

 

My son would not have the money to do this, but I would and have the earnings to do it.  Is there a way to co-sponsor?     I am really not certain of the easiest way, or how to go about finding the information. 

July 2010 - Hubby and our children moved back to USA (for work etc)

Nov 2010 - Visited for 3 weeks (it hurts like mad to be away from them)

June 2011 - visited for 4 weeks

26th June 2011 -I-130 Express Mail to Chicago

28th June 2011- I-130 Chicago signed for package

12th July - Returned to UK..

29th June 2011 - USCIS informed me Noa1 mailed on 29th June

2nd July 2011 - Touched

8th August 2011 - Expedite approved

12th August 2011 - Touched

12th August 2011 - The dreaded RFE!

9th September 2011 - RFE received by CSC - being reviewed!

13th September 2011 - USCIS approved

19th September 2011 - NVC received file.

4th October 2011 - NVC # assigned, emailed dob amendment email (amended now), emailed DS-3032, Logged into payment portal (not invoiced), booked medical - 20th October

He would need to save up or get a job that met the requirement, no joint sponsor.

Thanks Boiler.  Correct me if I am wrong, but if he got married to her, then I can co-sponsor?  They have been together for several years, so the intention is already there.  

 

In reality, they do not want to be apart.  I know he wouldn't have a problem getting a job that meets the requirements, but it would be the six months apart that they do not wish to do.

There's no co-sponsor option in UK immigration, unfortunately. 

 

There are a few different options which your son could take but all will take time. Has your son been working in the US? 

 

If they apply on the basis of a fiancee visa - they must also get married within six months and then make another application for her to remain in the country. That visa will last for 2.5 years and then require another application to stay in the country. 

 

The UK system is very expensive now and takes a long time to get to citizenship.

Re being apart: 

 

If he has a job with one company in the USA which currently meets the financial requirement and has held that job for six months PLUS has a verifiable job offer in the UK which meets the financial requirement and will start within 3 months of the move - then they should be able to move over together. If you meet the requirements the actual processing of the visa isn't anywhere near as long as the US one.
