Hi,

 

I just have a question about proof of domicile if anyone can help :) 

 

I am a us citizen living in the uk and planning on getting married in the uk next month. We are going to apply for a CR-1 soon after we get married. I have lived in the uk for schooling since primary school and have just completed my university degree. I have dual nationality and have been travelling back and forth between the us and uk on summer breaks. I have an address in the us which is my fathers and he has filed taxes for me as his dependent for the past 3 years, I have a bank account which has been unused for a few years and a credit card which has been used. We are planning to move to the us depending on the CR-1 decision and I was wondering if these things would be enough as proof of domicile?

more to think of

since you have not worked, who will be your cosponsor for the income requirment?

you do have a US address same as any of us attending a college (it is your home address where parents live)

after you marry, you will not be able to be claimed on your father's taxes

my father would be my cosponsor. I am filing my own taxes here but would the taxes filed before be taken into consideration? I have an address in the us and one in the uk, I’m living with my mother in the uk as she is a British citizen and live with my father in the us invetween as he is American

Just as you have to provide proof at the border you will come back for travel you have to provide proof at the consulate you fully intend on moving to the US. It's all pretty subjective and some people will skate by with little evidence while others will have to produce more.

 

If you were sitting on the other side of the desk with the evidence you have do you think that's enough to convince a complete stranger?

 

They want to do know where you intend on living and where you intend on working/going to school. They want to know for certain you will follow through with your plans. Going back and forth for visits shows you like traveling there but how will they know for certain you will move there?

I believe you have a lean case.  Any way to get set up at your father's house with a drivers license?

so would it be better to fly to the us after I file the I-130 for job applications and interviews along with getting my us driving license (I would only be able to go for around two weeks as I have a job in the uk) and say I am domiciled in the us, or would it be better to use the proof I already have (tax returns, credit card statements, bank statements, us address at my fathers house, health insurance that has only just run out) and say that I am domiciled or intend to domicile?

The proof of domicile is for the interview at the consulate after the I-130 is approved.  It will save time and money if you just ready your plan of room and board in the USA, where you will live, get affidavits of support, and apply at the embassy with a consulate.  A big stack of papers and proofs.  It's confidence that you will not be a wanderer or have a hard time.  You can fly to the U.S., or you can send resume' and apply online.  Prayers too.

In my view you are already close.  I believe that if you take the actions above you will be OK.  Especially with your father at his address filing as co-sponsor.
