Confused about what I need for AOS

Hi I arrived in September on my k1 visa and married my fiance on 10th November. We just received our marriage certificate back but I'm so confused reading the  what I need to include in my i485. Does anyone have a simplified version or a checklist link? Also is it going to take as long as the k1 visa took? Or is it dependent on the individuals? Thanks

The length of the overall process depends on the processing speed of your local office. Some offices take 4 months until the green card interview, some take over a year. EAD(I-765)/AP(I-131) processing times are currently around 3-5 months.

- Tax returns downloaded from IRS website (2016, 2015, 2014)

- 2016 W-2 Form

- 6 months paystubs

- Employment verification

- Sponsor’s birth certificate

 

I-765     

- 2 Passport Photos

- Passport pages (Bio page, K1 Visa, Stamps)

- I-94 Admission Record
- Copy of marriage certificate

 

I-131

- 2 Passport Photos

- I-94 Admission Record

- Passport pages (Bio page, K1 Visa, Stamps)
- Copy of marriage certificate

 

G-1145 for each packet (I-485, I-765, I-131)

$1225 check (includes biometrics fee)

Here is what we included in my husbands AOS/EAD/AP packet.  Hope this helps.  We filed on August 15, 2017 and his interview for green card is December 14, 2017.  So ours was processed super quick.  I think the normal processing time for AOS is about 8-12 months. 

  1. I-485 (AOS) Packet including the following forms and supporting documents.

    1. Money order/Payment in the amount of $1225.00

      1. $1140.00 – I-485 application fee

      2. $85.00 – Biometrics fee

    2. G-1145 – E-notification of application/petition acceptance

    3. I-485 – Application to register permanent residence or adjust status

    4. 2 passport photos (applicant)

    5. Copy of applicants passport (all relevant pages)

    6. Copy of Applicants K1 visa page in passport

    7. Copy of I-797 (NOA2) – From original I-129f application

    8. Copy of DS160 – From original I-129f

    9. Copy of applicants I-94 from most recent arrival

    10. Copy of applicants birth certificate

    11. Copy of applicants social security card

    12. Certified marriage certificate

  2. Copy of DS-3025 Vaccination Worksheet

  3. I-864 – Affidavit of Support Sub Packet with the following supporting documents from sponsor Elizabeth Ashley Wells:

    1. I-864 application

      1. Tax transcripts for years 2014, 2015, and 2016

      2. Copy of W-2s for years 2014, 2015, 2016

      3. 6 weeks of most recent pay stubs

    2. Proof of U.S. Sponsor’s Citizenship

      1. Copy of birth certificate

      2. Copy of biographical page of U.S. Passport

  4. I-765 (EAD) Packet including the following forms and supporting documents:

    1. Form G-1145 - E-notification of application/petition acceptance

    2. I-765 application for Employment Authorization

Certified copy. We requested multiple copies of our marriage certificate.

01/31/17.... K1 Visa Approved

02/03/17.... K1 Visa Received in Hand

06/05/17....Arrived in the USA (LAX)

06/24/17....Married on Cape Cod <3

 

07/10/17....Sent AOS package (I-485, I-131, I-765)

07/17/17.... AOS notice date for NOA1 (I-485, I-131, I-765)

07/21/17.... Received mailed hardcopies of NOA1s

07/29/17.... Biometrics Notice received in mail 

08/01/17.... Biometrics Appointment AOS - complete (walked in)

08/07/17.... Biometrics Appointment EAD - complete (walked in)

10/23/17.... EAD/AP card delivered to house YAY!

Adjustment of Status:

 

Mailed the following things to https://www.uscis.gov/i-485-addresses:

  1. Payment as required by USCIS (I-485 + Biometric) (https://www.uscis.gov/forms/our-fees and https://www.uscis.gov/forms/paying-uscis-fees). This was 1225 USD for me when I filed.
  2. Form G-1145: e-Notification of Application/Petition Acceptance (optional but I think it is helpful to get electronic notifications).
  3. Form I-485: Petition for Alien Relative.
  4. Copy of the non-US Citizen Spouses Passport, the biographical page as well as entry stamps.
  5. Copy of the non-US Citizen Spouses K-1.
  6. Copy of NOA2 "Approval" for I-129F.
  7. Electronic I-94 Copy (It's important to get this online ASAP because it expires, so do this immediately.) (https://i94.cbp.dhs.gov/I94/#/home)
  8. A copy of the intending immigrant's birth certificate 
  9. Certified copy of marriage certificate
  10. Joint Bank Account
  11. Joint Lease
  12. Two passport photos
  13. I-693, Medical Examination of Aliens Seeking Adjustment of Status. (The K1 medical expires so it's best to file the I485 before it expires of you will pay for the medical again and it's expensive. We were missing shots so it was necessary to get those when she arrived in the USA. A civil surgeon must do the shots and paperwork. You will get a copy of shots paperwork and a sealed envelope that you are not allowed to open that should be sent with your I-693. The shots cost us 180 USD for flu and for remaining tetanus).
  14. I-864: Affidavit of Support (along with tax transcripts, w2s, pay stubs, employment letter, and bank statements)
  15. I-765: Application for Employment Authorization (optional and free when filing with the I-485)
  16. Biometrics was a breeze. Took the appointment letter USCIS sen tot the Lakeline location in Austin. She was in and out in about 10 minutes.
  17. We received a request for initial evidence for birth certificate translation on Nov 3rd 2017. This was a bit odd because her birth certificate was already in English, from England. We hired a translator (ASAP Translate) to translate her birth certificate from English to English and certify it. We sent the package off to them on Nov 13th 2017. RFIE Delivered on Nov 15th 2017.
