Hello everyone,

I got a letter from USCIS titled "Request for Initial Evidence I-485"

They said I needed to fill out a form I-864 for my petitioner ( my wife) even if she's not the main sponsor, because I initially only sent 1 I-864 for my joint sponsor,  My wife doesn't work though, she is still in college and hasn't filed any tax returns before

Question 1: Should she just fill an I-864 form and write a letter saying she never worked before and she has not filed any tax returns before?

 

In the same letter they said : Based on the documents you submitted with from I-864, Affidavit of Support, for the joint sponsor, the income did not meet 125% of the poverty guideline.

Question 2: here where it gets confusing my joint sponsor is a family friend who has a wife and a child but makes over 100k a year in his latest filing for taxes. Why did they say it didn't meet 125% of the poverty guideline which should be around 35k for him?

Your wife has to submit her own I-864, since she is the primary sponsor (even if she has no income). 

 

What evidence did you/the joint sponsor provide along with the I-864? I would also look over the I-864 that you sent again and make sure everything was filled out correctly (correct household size, total income, ect). It's also possible that USCIS lost any additional documentation that you provided to them, it happens more often than it should. You may need to resend both I-864s, and all support documents such as tax returns from the joint sponsor, pay stubs, employment letter, ect.

The joint sponsor submitted 3 previous tax returns, I-864 was filled out correctly by the joint sponsor, I have a copy of that I-864 for my joint sponsor, should I send it and reference it? or should it be the original? I have also forgotten to sent the proof of citizenship for the sponsor, so I will be doing that too.

They said you didn't meet the requirements as that is standard language on these RFEs (from all I've seen on here). Your wife does need to submit her own I-864 regardless of her lack of income and filed taxes - she's the main sponsor.
