Withdrew I-130 and new petition accepted in Madrid

Hi everyone

I just wanted to update an earlier post: I filed an I-130 and I-485 in the US in 2005 but we had to move to Spain. Tried to re-file using DCF in the Madrid Embassy, but the I-130 was rejected because of the earlier petition which was still "pending."

I "withdrew/terminated" the first I-130 by sending a letter to USCIS requesting withdrawal/termination and the Embassy accepted my new petition!! This is what I brought with me:

1. an e-mail from USCIS Rome saying that I could withdraw my pending applications in the US and re-file in Madrid (this was probably the most important because they wanted something in writing, and the Madrid Embassy is under the jurisdiction of USCIS Rome)

2. a copy of the letter

3. a printout from DHL showing that the package was signed for at USCIS New York

4. a printout from the India Embassy showing that a photocopy of a letter requesting termination sent certified mail is acceptable proof of withdrawal

I know that alot of people have had success in re-filing their I-130 after the Adam Walsh act, but I wanted to mention my situation specifically since I wanted to re-file due to personal circumstances, rather than procedural changes caused by Adam Walsh.

I also wanted to mention that the whole process went really well: took about 2 hours, and all the people I dealt with were extremely nice. Also, they only wanted one copy of the G-325A, as mentioned in another thread.

01/12/2007 I-130 filed in person at the Consulate in Frankfurt

01/17/2007 Faxed the checklist to the Immigrant Visa Unit in Frankfurt

03/29/2007 Got letter from USCIS to provide evidence that our marriage is bona fide

04/02/2007 Sent to USCIS lots of evidence

05/03/2007 I have an unofficial "PETITION APPROVED" ...waiting for confirmation from Consulate

05/07/2007 Received email from USCIS ROME confirming that our petition was approved (why Rome? because we complained to the District Office Rome about the Sub-Office Frankfurt..it took too long for our petition to be approved)...now waiting for the interview letter from the Consulate

05/18/2007 E-mail from IV Frankfurt, our interview was scheduled for May 29th

05/19/2007 Packet 4 in the mail: ja ja ja interview letter

05/29/2007 Interview at 7.30 a.m. APPROVED Thank you, God!

06/01/2007 Visa arrived !

06/03/2007 Mayday on the plane POE Cincinnati

Living in Maryland

06/21/2007 Welcome Notice from USCIS

06/29/2007 Applied for SSN at the local Office

07/07/2007 Green Card arrived

07/09/2007 Another 2 Welcome Letters from USCIS...God, they really love me! :D

07/20/2007 Social Security Card arrived

01/18/2009 PCS-ing to Stuttgart Germany

Feb 2009 Received letter from VSC to start removing conditions.

Getting ready the packet for Removing Conditions I-751

I am kind of in a similar situation and not exactly sure what will happen. In October of 2003 I filed a K-1 for my fiance at the time in the US. I ended up moving to Prague and now we are in Poland. Now we are ready to go back to the US and I will be filing the I-130 because we have gotten married in the mean time. I didn't do anything with the K-1 do you think this will pose any problems?

June 1, 2007: I-130 delivered at Embassy

June 1, 2007: Received packet 3

June 10,2007: Sent DS-230 part 1 by email

July 26, 2007: Applied for SVK police cert. at embassy in Warsaw

July 27, 2007: Applied/Received Polish police certificate.

August 7, 2007: Applied for CZK police certificate at embassy in Warsaw

September 5, 2007: Received SVK police certificate

September 5, 2007: Medical examination

September 13, 2007: Received CZK police certificate

September 14, 2007: Emailed form IV/F04 (checklist) to embassy saying we have all documents and are ready for interview.

September 28, 2007: Received email saying they couldn't open the attachment so I sent IV/F04/checklist by fax.

October 10, 2007: Received email confirming they have received fax

October 16, 2007: Received Packet 4

November 15, 2007: Interview, (had to have two police certs translated to English instead of Polish)

November 16, 2007: Two police cert. brought to embassy. Visa approved!!!!!

November 19, 2007: Visa in hand.

March 23, 2008: POE Chicago, IL
