Hi,

 

just wondering if anyone has any experience with this or advice.

 

I am a dual National of the UK and USA, my fiancé is from Pakistan and we both met while studying in the UK and have lived together for the last 3 years. We have decided to get married and move to the US where my family are. I am just filling out the I-129f and have a few questions.

1. We have been living together for three years so do not have plane tickets etc to show proof of meeting, the house we live in is in my grandmothers name along with bills so do not have our names in them. we do have bank statements and driving licenses with the same address on them and photographs through the years together with family members. Will this be enough proof of meeting in the last two years?

2. Do I need to give a certified copy of my birth certificate for proof of citizenship or just a normal copy? 

3. Should I put my physical address as my address in the UK and my mailing address as my parents address in the US where we intend to live? 

4. My fiancé is legally living in the UK and has been for the last 6 years but is a Pakistani citizen, will he be able to attend a consulate interview in the UK?

 

also how would I present the evidence of meeting in the letter and in the packet?

 

any advice on this would be much appreciated :)

Thanks for your reply! I looked online but the London Embassy says that the petition can only be filed with USCIS in the United States. I think this is a recent change.

Because this is fiancé visa

 

if you do dcf that's for spouse visa. (I-130)

If you can get married in the U.K. Instead

it is faster, cheaper and I wish I could do it too 😂😂

I agree...marry and do DCF for a CR-1 visa instead. It's a matter of a few months versus 7-9 months for a K-1, plus it's considerably cheaper and is a superior visa in every way (can work and travel abroad right away). The only advantage of a K-1 over a CR-1 is that it's usually faster (but still slower than going through DCF for a CR-1).

If you want to proceed with the I-129F for the K1, you basically supply any proof that you've spent time together in the last 2 years.  Proof you are both residing in the UK and maybe a photo of you two holding up today's paper or bank/credit card transactions showing you are both in the same city, mail addressed to one or both of you at your address, etc.  You are going to have to be a little creative and that's fine... sometimes people have to do that.

 

I'd highly suggest marrying and doing a DCF filing.  You don't need to submit any evidence at all of a bonafide relationship with the I-130 if you DCF in London.  Much much easier.

 

Your fiancé will need police certificates from Pakistan, but can interview in a country he is a legal resident of.

my problem with the CR-1 is that I’ve heard the London Embassy does not allow a financial cosponsor to meet the income requirements. We have both just finished our degrees and currently job searching so do not meet it ourselves. I have a cosponsor in the US but don’t think we can use them.

Hi! I filed while abroad and these are my best responses to your questions.

1. I would scan a copy of your passport page showing the stamp(s) whwen you entered the country in which you met your fiance. And if you still have even the email version of your itinerary of flying to the country in which you met along with the stamp would be good. That can kind of start your story of how you met there when you explain how you met.  Also for proof of relationship, important events of meeting family and friends is good and if you guys did any traveling together too if you want you can include a few photos and plane tickets or itinerary with your names. I think the embassy will see you guys are legit if you've been living together for 3 years.

2. I think I sent the copy of my birth certificate...I have to double check (I'm at work so I can come back and edit my response)

3. And yes put your physical address in the UK and mailing as your parents US address. 

4. Sorry I'm not sure what the response is for that :/ 

 

And to present how you met Qt 54 you can write something like "See Attachment" and just in summary write how you met. For example, for me, I forgot to mention that I was in Colombia but I named the neighborhood where we had our first date after my husband asked for my number at the bar he was working at. I explained what we did on our first date and how we continued talking...(it wasn't this short but this is the gist).

I believe that might be incorrect information.

I believe so too...a CR-1 uses the I-864, which they must consider a joint sponsor in determining the public charge concern.

Yes...with the CR1 you use the I-864 which has the same rules for everyone and allows use of another sponsor.

It's with the K-1 and the I-134 that different consulates do different things.

Definitely do DCF. I had the opportunity to do it and regret not doing it. I filed K-1 about a year ago and still no green card. Please don't make the same mistake we did. You can always have a second ceremony in USA.
