Disabled Veteran Filing for Married Spouse

Helloooo there,

 

I filed for my spouse in May, 2017, but had to resign and is currently on medical disability (put on disability by my VA Psychiatrist)  for post deployment issues. At some point, would I have to verify employment? and what are my alternatives if I cannot to work at this time? I do not want to delay my case. I heard that I can have a family member "co-sign"  as in send their employment/taxes etc., in lieu of mine.

Timeline

I believe as long as you meet the income requirement you would be fine (which could be met depending on your rating/the amount you receive). The issue may be showing tax returns as your VA benefits are not taxable, therefore not reportable to the IRS. However, an income or benefit letter may suffice - I don’t know for sure. Yes, you can have a co-sponsor.

We were in a similar situation, my husband is a disabled veteran and USCIS accepted the benefit letter as proof of income - we also wrote a letter explaining the reasons why he had no tax returns (because of VA benefits not being taxable) and quoted the relevant parts of IRS documentation for this.

11/07/2017 - Mailed I-751 to CSC

11/13/2017 - I-751 delivered to CSC

11/13/2017 - NOA1 Date

11/17/2017 - Received NOA Letter

11/17/2017 - Date of Biometrics Letter

11/24/2017 - Biometrics Letter received

12/08/2017 - Biometrics Appointment Date

08/16/2018 - 18 month extension letter received (dated 08/11/2018)

02/12/2019 - New Card is being Produced

02/22/2019 - 10 Year Green Card received
