k-1 Criminal Record

Timeline

I am in the process of filing a k1 visa and I have a domestic violence charge from 13 years ago which was expunged.   It was an incident for which I accept responsibility, there were no major injuries -  grabbing and pushing on my part which was wrong.  All of the records at the court house have been destroyed and I called the prosecutors office and they have destroyed the records as well because it has been expunged.  My attorney also doesn't have records that far back.   I plan on checking yes on the box but I dont have any of the copies of the court copies, police records and neither does anyone else.  Anyone run into this problem and if so what did you do when it asks you to provide this information.

 

I also have a DUI charge from 10 years ago but was found not guilty at trial and the records for that case were expunged as well.  

I plan on disclosing that but again dont have any copies of court documents.

 

Any advice would be appreciated.

Well the instructions for k1 say that you need send with the petition package all the court records even if the charges were delated.

And be sure that your fiance have copies of that records at the interview.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

January 13, 2023 apply for us passport.( regular service).

Timeline

Just went through the Certificates of Conviction process at the CSC.  I had a few drug convictions only.  With  domestic violence you will likely have more problems than I had.  Prepare to wait like we did for at least 10 months to get NOA2/USCIS approval.  My 129f just sat and nothing happened until I made an appointment with Congressman and made my case provided documents of everything and anything to prove myself a safe person who can support my Beneficiary.

 

You will need to go to courthouse and get certificate of disposition.  I don't believe court records were destroyed and there are always computer entries  (although my divorce records were indeed destroyed by a flood but that is  civil not criminal, LOL).  Court Clerk's office will find your documents. The pivotal question is: Were you finger-printed? Hope for an RFE to submit them.
