I'm Canadian, my Fiance is American. About a month ago, we submitted our initial application for a K1 Visa, and the status reads as received.

 

It's my understanding that i should be receiving something in the mail for the next part of this process. I received a letter that I THINK was from a canadian immigration office. The reason I'm not sure, is because I was out of town and unable to sign for it. It was returned to sender. Canada post is unable to tell me who sent the letter. Just that it came from Mississauga (where there is an immigration office). I've tried calling the Canadian immigration support number, but none of the automated options apply to me, as I am applying for an American visa. And I can't get through to a live agent.

 

Can anyone shed any light on this process, and what I should do? Does it make sense that I should be receiving something in the mail from the Canadian government at this point in our timeline? Will they re-send the paperwork? Will my fiance receive an update regarding the failed attempt? Any information you can give would be helpful, as I cant seem to find any help on the CIC website or on the phone.

You won't be receiving any mail from the Canadian government in relation to the K1 visa. The American petitioner will first receive NOA2 approval notice in their mail about 5-7 months after you mailed the initial I-129F paperwork. Once the petition is approved, you will then receive instructions on what to do in order to prepare for your interview, but those instructions will come from the US consulate in Montreal.

No. The guide says you will get a form and checklist about a week after the case has been received by the US consulate/embassy. You haven't reached step 6 yet either. You're at step 3 on that flowchart. You've got quite awhile until you will reach any of stages in your screen shot (4+ months from now likely).

 

And the Canadian government won't be sending you anything that's related to this process.

Yes, but you're still on Step 2, waiting to get to Step 3 which is receipt of NOA1. That goes to the petitioner from USCIS. Also, when you receive a checklist step 8-- that comes from the US Embassy not Canadian Immigration. Also, they seem to email (or at least they did from my husband's country). 

 

Now, if I've misunderstood, and you are on steps 7 and 8, then you may want to get in contact with the US embassy and see if they sent something. 

 

Also, fill in your timeline, it makes helping a lot easier :)

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

In about 6 months your USC petitioner will get NOA2 (or a decision on the I-129F.)  After that the I-129F is routed to the NVC where it gets a DOS number and is sent to Montreal.  Then, you can send packet 3 and recieve packet 4 and schedule your interview and medical.  But you have quite some time until then.  Canadian immigration deals with people immigrating to Canada, not emigrating from. Everything you will do will be with US immigration; from the USCIS, with the petition, to the DOS, which is the NVC and consulate. 

 

Then you get to deal with the USCIS again to adjust your status to get the green card.  

 

Personally, I dont understand why Canadians continue to do the K1 when the CR1 gives you a lot more advantages after you move.  But to each their own. I guess the idea of being married and not living together yet just outweighs everything else.
