Hi! I send an I-130 on August 8th 2017  Texas Center.  I know is going to take a couple of months  before we get an answer, but I wanted to know what to do next. Should I filed for a 485 now or should I wait on the approval?  Also has any one done their on FOIA online? If so can you help me out.  I need to get all the CBP records  to make sure everything is going to be ok.

Is he in the US at this very moment? What status did he enter on?

What issues might he have? A FOIA request isn't typically necessary unless there are specific concerns.

we are waiting on a approval for a humanitarian Parole overseas

You must be in the US in order to file for Adjustment of Status. Until he is in the US, he has no status to adjust.

 

IF the parole is approved, depending on why he was unable to obtain a visa - and the terms of the parole - will determine if he is eligible to adjust status once inside the US. A parole doesn't necessarily make an inadmissibility for a visa or AOS go away.
