I am in a bit of a strange situation. We filed an I130 on Jan 4th and I129 on Jan. 11th. The I130 was approved on Mar. 6th and the I129f was approved on April 19th.

In the interim I was offered a job at a University in the U.S. I am eligible for a "non-cap"(?) H1B Visa. The job starts Aug.16th so the earliest I would be allowed in the U.S. on that visa is Aug. 6th.

So my question is what should we do from here? Our I130 is at the NVC waiting for us to pay the bill. The I129f has not yet been received by the NVC. Should we pay the I130 and go down that path (get Immigrant Visa in Montreal).

Should we keep going for the K3 and then apply for an EAD/AOS when I get to the U.S.? If we do that, what are the chances of having work authorization by Aug. 16th?

Or should we abandon the family immigration and pursue the H1B?

Is there anyway I can immigrate on a K-3 and then trandfer to an H1B if the AOS/EAD doesn't come through in time?

Sorry to ask somany questions, but I really don't know what to do now.

I would abandon the I-130 for now and pursue both the H1B and K3. Let the fastest horse win. In either event, the approved I-130 becomes your basis for adjusting status. Completing the CR1 or IR1 in time, seems quite unlikely and paying the fee is money down the drain, if you end up adjusting status.
