Hey guys,

 

I cant seem to find a thread for this. I am a US citizen filing a I-130 for my son. I feel like there should be more. Once the I-130 is approve is he able to fly to the USA so he can start school here in September of next year?

If you were a U.S. citizen when your son was born, chances are he's already a U.S. citizen and will need a Consular Report of Birth Abroad and his U.S. passport to travel to the U.S. Otherwise, you'll have to start with an I-130 for him then proceed with an immigrant visa at National Visa Center stage for consular processing abroad. Information is still required though since you didn't specify your status when he was born.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

Once the i-130 is approved the petition will be sent to the consulate and he will get a visa (F-1). I'm not sure it will be ready by September since it takes ~12 months. 

 

Anyway, you should start making plans for him to start high school in the US as soon as possible. Is he learning English? Maybe even try to get a list of items he should know from a local high school. It will be easier in basic subjects, like math. Finishing high school in the US will definitely be better for him if he wants to live in the US but to make the transition smoother you can find out about what would be useful for him to know.

His english is super fluent. Great idea on the list.. school in the Philippines starts in June and September here so I don't want him to miss either. Thank you for your input.

I understand... My divorce was ongoing it just got finalized, thus the delay.. Any chance he can travel to the US then, any idea?

Better Dec, then he at least should get a full semester of US school in (depending on state). March very close to the end of US year and not sure how much value he’d get out of that.

But that means he is going to school from June (Philippines) to July (US)? little too much maybe

He can always renew his passport before going to the consulate (I don't know how long it takes in Philippines but that is something to take into consideration). If his passport expires on May, he should do that, particularly because it is better to have a non-expired passport once he moves to the US. He will still need it to travel abroad and you don't to have to go to a consulate to renew it (if that is even possible).  

 

Visas are usually valid for 6 months so once he has the stamp on the visa, he can wait to finish school in the Philippines to travel. You can also set the date to go to the consulate so that it is not too far from when he is expected to travel. But take into account that it is best for the medical to be close to the consulate date.
