Hello everyone,

I will be sending my petition for my wife next week. I am trying to double check everything before I send the application forms. 

 

My current question:

I am living in Japan as an intra-company transferee visa from a USA company. An intra-company transferee is when a company transfers an employee to work temporarily in a different office, often in another country. For my situation, I am currently employed by my company in USA and I am paid by my company in USA, but I live and work in Japan. Do I need to list on the I-130 the company in Japan where I am training? If so, do I simply write present for both the USA company and the Japanese company end dates?

Often times the assumption on these forms is that you have to fill in the blanks and that if it doesn't fit in the blanks then you can''t put it it.  I would suggest since you are filing from Japan that you put the Japanese Company name and information and put end date present.. . Then on the next line put simply the words see attached document. 

You would then put a title of ATTACHED document RE: Question #xx and put the address of the US company and include  information and perhaps  a copy of your inter company agreement.  Ideally that agreement will make it clear what the end date of this international assignment is and that you have a position with your current salary when you return to the USA.  When I filled for my now wife and interviewed in HK while on an international assignment the visa for my then Fiancee was delayed until I got a letter from my US manager indicating that I had employment in the USA.  I too was paid by the company in the USA while working abroad.   If you can 'front load' your application with the above information it should help your wife at interview time while clearly representing the material facts of the situation.

Thank you for the advice. I have now contacted my companies human resources department to get the employment letter you mentioned to prove I have employment in USA. However, I do not think I can provide a copy of my inter-company agreement. The agreement is around 100 pages in length. Is the letter enough or should I copy selected pages of the agreement document?

The letter would be preferable but I would not suggest that you delay submission for the sake of getting the letter.  If you can get it in time that's great!  If not then submit an explanation of the circumstances and provide the letter to your wife to bring to her interview.   The consulate may want some proof that you have or intend to re-establish domicile in the USA.  Worst case they will do what they did to us and provisionally grant the visa but keep it in AP until they get and verify the letter.   Better to avoid it all if you can submit upfront.

Sounds like the Japanese company is NOT your employer.  If you are employed by Ford Motor Company in Dearborn, MI, then that's where you are employed regardless of where your current assigned workplace may be.  Unless you are actually employed by two separate companies, you just list the one employer.

Facts are cheap...knowing how to use them is precious...

I spoke to human resources and they informed me that both the Japanese company and the USA company are paying me a split salary. Both companies have me listed as an employee. I will write both companies in my visa petition and attach the HR employment letter from USA.

Excellent sounds like you are well on your way..   Note however, that if you have a 'split salary' now you may want your letter to document what your salary would be when you return to the USA and the expected date that is going to happen.  Doesn't have to be now but at interview time it may be a requirement (or may not be).  Good luck to you and your wife in your journey
