Greetings,

 

I know this question i'm about to ask is pretty basic and stupid but let me ask it anyways.

So my mother just got her green card and i'm about to be 20 years old next february. Someone, weirdly enough, told me that after asking an attorney, I could get my case dealt with in less than a year if I apply even two seconds before turning 20 (which in my opinion is a pretty stupid statement since not even the priority date is this quick to be current). I know and I'm positive that the f2a process takes two years in general, but I would just like someone to review this information and their interpretation, maybe it could be related to CSPA (which is pretty stupid too) or maybe this person could just be fooling me around.

Nothing wrong with asking. Trust me, on VJ we get these type of “ someone told me” questions all the time. 

 

Everybody knows someone that can do something for you. It is only giving you false hope.

 

However, with that said, it is not entirely impossible. I’ve seen some very fast cases. I’ve seen a K1, which takes roughly 6 months, get approve in 1 month. Never seen an F2A case get approved that fast though.

It currently is taking about 18 months from I-130 filing to the PD becoming current. The time that the I-130 is filed but not yet approved can be subtracted from the beneficiary's age for CSPA circumstances.

The entire process, assuming your CSPA-adjusted age remained under 21, would still be about 2 years from filing to visa. An F2A case cannot proceed until the PD is current, so even if a case were to be expedited, it would still have the ~18 month wait followed by NVC and embassy processing.

 

I also don't want to give you false hope. With CSPA, it is possible to qualify under F2A still (but not a green card within a year). If the I-130 takes 9+ months to process (which isn't impossible), then that buys you 9+ months to avoid aging out into F2B. At that point, you may make it through the rest of the process in time if filed before you turn 21.

Then again, the 18 months is only an estimate...it could grow to 20+ months by then. There's a lot of critical factors that cannot be known beforehand (how long it will take for the I-130 to be processed, when exactly the PD will become current, etc.).
