Questions regarding Fiance letter of intent [merged threads]

Hello all,

 

I am new to the process and also to this site. I think you all in advance for your help.

 

Regarding the fiance letter of intent, is the styling of the document important? I see that on the example document, the names are in red. Does this NEED  to be the case? Does this even matter? I just want to make sure I'm not inadvertently messing anything up.

The letter of intent is a required part of the petition process. Without one, your petition cannot be approved.

 

There are no requirements regarding the style, however. Write it how you want. You just need to be clear that you are free to marry and that you fully intend to marry your fiancé within 90 days of the alien fiance's arrival in the country. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

Yes, you will need a second set of letters of intent at your interview. It tells the officers that you still intend to get married even though it took them half a lifetime to get the darn thing approved. 
It's the same letter as during your initial petition only a date that is closer to the interview.

A new letter might be needed at interview if the petition has expired by the time the interview date comes round. It depends how long you have to wait for an interview.

Hello all, Thank you to everyone who has been a help so far.

 

Regarding the fiance letter of intent, is the filing address the same for both the beneficiary and petitioner? Why does the example given on VJ show both US department of homeland security as well as US Citizenship and Immigration services? Which title needs to be on this document?

Read the guide slowly. It's a lot of information and it takes a few readings to get it all in your head. I made myself a checklist, that really helped. 

 

There is only one petition, that is the petition from the United States Citizen to grant the beneficiary an opportunity to apply for the visa. All documents need to be in that one petition. Both the letters of intent need to be in there. All the documents need to be gathered by the petitioner to send off.

 

Once the petition is done and it is granted, there is no petition anymore. There is only the application for the Visa. That application happens at the interview. That interview is in the beneficiaries country and needs to be done by the beneficiary. In that inverview another set of letters of intent is asked, like we explained in your last topic.

 

On that note. It is easier if you a) ask all your questions in one thread so we can understand the questions as a whole. And b) please update your timeline a bit (country, kind of visa, ect). The more info we have, the better we can help you.

Hello all, 

 

I'm having my SO fill out the fiance letter of intent and mail it to me from France. I typed in the date that she would be signing it (11/27/17) however with the time that it takes to get to me and then however many days after that to get everything else in the package and sent to USCIS, will this pose a problem? Is there an expiration on the date that it needs to be? Should I have done the date differently?

I had one other question regarding this document. I posted another thread however I saw your post after and realized it should have been included in the original post I had made (I'm trying to learn the correct way to use this site). Regarding the date of the fiance letter of intent. Does this have a huge importance? I have it typed and my fiance signed it for today, however I'm not sure when I will be sending  it. Is there an expiration on this?

I have not seen any term within which the letter needs to be signed, but I suggest to have it as close to filing as possible. It kind of looks funny if she signed it today and you wont put in the petition for another 6 months.

As for the second letter of intent, that one needs to be signed after the petition but before the interview. Again as close to the interview date as possible. They want to know you are still intent on marrying eachother. So sending in a letter she wrote a year ago won't show them she still does today.

Thank you. You have been very helpful so far. I don't plan on waiting six months to file but the signature date would be today and then I would probably send my package within the next month. Im also wondering if this date needs to be typed or handwritten or if that even makes a difference. I know I'm being extremely meticulous however I just don't want to do anything inadvertently.
