Hello All,

 

My K1 wife and I got married and then applied for the AOS, AP, and EAD. She received a notification email on Aug 1 saying that the applications were accepted and being processed. She took her bio-metrics exam on August 30th and then we haven't heard anything else. When we check the case status online, it says that there is an RFE sent on Aug 21. We never received the RFE in the mail and have since filed two e-requests for the mail to be re-sent. The first request has expired after 30 days, and we are currently on the 2nd request, set to expire on the 13th of December. On the phone, the people aren't very helpful and just tell us to wait. The AP, and the EAD, are also over due and we haven't heard a reply. Is this normal? Is there anything else I can do? I'm worried that the AOS will be rejected because the RFE has not been responded to in the corresponding time.  The last thing I want is for my wife to return to her home country, or to start the process all over again. Please help if you can!

I wouldn't wait any longer. Find your congressman or senator's immigration liaison, complete their release of information forms and walk in to their local office with all the paperwork you have (screenshots showing you have RFE as well). They have direct line of communication with USCIS (fax, phone, email) and can sort this out for you.

Would they be able to help them even if a request is pending?
