B1/B2 waiver of Ineligibility - Busienss Travel

My First Post here.

Embarrassingly I was convicted of a minor crime during my teens that makes me ineligible to travel the USA on an ESTA and I require a waiver of ineligibility.

I have travelled to the US many times after being granted ineligibility waivers. 15 years on and I recently got issues a 5 year visa waiver of ineligibility 212(small D)(3)(A) waiver of 212(A)(2)(A)(2).

The visa type states -R B1/B2.

I have a new job in the UK that has travel to the  US. In the UK my conviction is long spent so I do not need to disclose this to the company.

I am assuming that the above visa enables me to travel to the US to the US for both business and Tourism. So I wouldn’t need anything else if I was working out there periodically for throughout the year for 1 or 2 weeks. Is that correct?

Also, if the above is correct how long can I stay in the US on any one trip?

Thanks in advanced for any advice.

John

B1 is for Business, not work.

You can stay for as long as on your I 94. Too many trips and you may be questioned.

Sorry what’s I94?

Your arrival record. You will get a stamp in your passport with a date on it. That's the latest you must leave - it varies how much time they give you.

You can also check it online here:

As previously mentioned, B-2 is for business, not work. So you can use it for meetings, conferences, discussions, site and plant visits, etc. But not to work here.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Thank you for explaining.

Just a brief example of what I do and would be doing.

I am a project manager employed in the UK by a UK firm who manages a project team across Europe and America. The majority of work I’ll be carrying out will be in the UK but I would be required to travel periodically, to the states. For example a week every two months to meet with the team for updates, workshops, meetings etc.

Could this be carried out on a B-2 visa?

if not which is the work visa that would be required?

Apologies but all this is new to me.

Thanks,

John

It seems those activities are within the B2 but read carefully the link above. You will probably be asked about what you will do at the POE and you want to use the correct wording. Also, the list in the pdf is the perfect excuse not to do certain types of tasks in your visits. Do not be shy to say you cannot do something due to your visa restrictions; people completely understand that. You can always say you will do something when you get back to the UK.
