Wrong, you can get married by a JOP or a religious wedding. It is all up to you honestly.

so why when we applied for the marriage license at the town hall they gave us list of justcies of peace of the town where we live? I think it is mandatory, so if we want to have a religious wedding it should be in church my wife and I we not on the same religion, so what to do?

You just need to have a legal wedding so that you are married in the eyes of the government. It can be done through a justice of peace, at a courthouse, in a church or mosque, anywhere as long as the person signing the marriage license has legal authority to do so. We got married in a courthouse and then had an Islamic ceremony that was purely symbolic, though we could have had the legal wedding there. My spouse and I are not of the same religion.

You can be married by anyone licensed to marry you  (religious or otherwise). The list of the justices of the peace is just for your information. My local court house gives a list also when you apply for a marriage license.

Check with your local county on what they require for a courthouse marriage. In our case, we drove to a neighboring county to get married because they did courthouse weddings on Saturday's and that was convenient for us. We just showed up that morning, no appointment or anything. However each county may have different rules and days/times when marriages are performed, so I would start with your county's website.
