k1 fiance and affidavit, what If I can't file taxes this year?

Hey guys this year I didn't work because I was living in my fiance country, so what can I do? If apparently, I can't file any taxes? they would ask me for this even if I can't file? Or should I try to file taxes ? Or I have to file taxes if i wasnt living in us and wasnt working? how does this works?

All Americans are required to file taxes even if not living in the us, you can still file even if you didn’t earn anything, there is an exemption amount if you did happen to earn money whilst living overseas as well to avoid double taxation.

 

Personally I would file even though you didn’t meet the income amount for filing that way you have a return as requested rather than having to explain in a letter you were below the filing threshold so didn’t need to file. I don’t trust uscis to understand a letter to be honest :-)

but how i do it? if i dont have a w2 and it says i'm except from filling taxes if earn less than 10.000, i already say that i didnt work in this year so i dont earn no money at all. why u say all americans are required ? no everyone if they are not qualify for this... or how im supposed to file taxes? if i dont have nothing to show?

You can just rely on them understanding a letter that you state that you don’t need to file as you are not earning the minimum but that’s up to you.

 

Personally I think that USCIS are idiots and can’t understand anything other than an official document.

 

If you decide that you want to go the filing route the following should help.

 

https://www.irs.gov/individuals/international-taxpayers/taxpayers-living-abroad

 

You won’t use a w2 even if you were employed overseas you wouldn’t have one.   You don’t include any proof of income with the tax form. 

 

You fill in the 1040 plus another form that is for foreign income which I have linked to below, put in the foreign earned income exemption as per the instructions, put in that you earnt $0 from all sources, send it to the address on the link above.

Just to clarify the above...not all Americans are required to file taxes. However, all USC and LPRs are taxed on their worldwide income. If their income is above a minimum threshold, then they are required to file. This goes the same for individuals living inside the US or abroad.

Nobody is prevented from filing taxes, even if they are not required to do so.

With no worldwide income at all, you can either 1) provide a signed letter/affidavit that you were not required to file for the tax year along with the I-134, or 2) file your taxes.
