I-130 Evidence Organization (Spouse)

I am in the process of finalizing my husbands and my evidence for bona fide marriage as well as everything else needed. 

 

On a a macro level my package checklist is as follows:

1) Completed I-130 newest edition 

2) I-130A

3) G-1145

4) Civil marriage certificates

5) My US birth certificate 

6) 2 passport photos of petitioner and beneficiary in separate zip lock bags with our name on our picture written in black felt tip pen

7) Documents showing bona fide marriage (evidence)

8) Filing fee

9) Cover letter (I know it's optional but I think it makes everything look professional)

 

As for my evidence is as follows:

1) Plane ticket copies

2) Receipts from gifts and things done together 

3) Passport copies of both of us to prove times we traveled together 

4) Screenshots of conversations

5) Pictures of us together 

6) Screenshots of pictures of us together to prove various dates and times 

7) 3 letters of affidavit of bona fide marriage 

8) My statement notarized of our love for each other and our marriage bona fide

9) Copies of Western Union receipt papers that we each had when sending money to each other

10) Copies of letters written to each other

11) Accident insurance beneficiary 

12) Whole life insurance beneficiary 

13) Bank account POD beneficiary 

The last three my husband is the receiver of these policies and the account.

 

Is there anything I'm missing?

What about Western Union receipts? Should these be included or will this make our genuine love look like a sham?

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

We submitted everything except for your (entire) evidence list. 

 

My petitions looked like:

 

Petition docs

My ID info (passport and BC and what used to be the G-325A biographic info)

Divorce decree (mine, previous marriage)

 

That's it.  No RFE, no processing delays.

 

SO:  Based on our experience(s) It looks like you're good to go.  Best of luck

I'm assuming RFE means evidence? How does evidence slow the process? I've researched and heard some say it made it faster.

Never mind my previous questions. I understand your statements now. You are saying with the evidence we are submitting, we should have no RFEs which will slow down this application process. Thanks so much for your help!!!!!!!

Yes sorry if there was misunderstanding.  I was saying that your file is way thicker than ours was and that it looks like you are good to go.

 

In my experience (only) from watching these cases and our personal experience with the process USC's with overseas spouses don't have a lot of evidence of things like co-mingled assets, etc.  Their cases are what the list in the petition is about and usually completing the checklist of attachments is the only thing that needs to be done.

 

Under other filing categories such as B1----->adjustment of status or other visa categories of filing where both the USC and immigrant are in the US the required evidence is a little bit tougher.  Those seem to be the cases where evidence other than the I130 checklist attachments are requested and necessary to convince USCIS to let an immigrant who is in the US under one category adjust their status to green card holder.
