Tax return impossible

Hi all !

- My USC wife has been in the UK for 10 years. That's how long we've been married.

- She hasn't worked for 30 years.

- Her exhusband who took care of these things in the US is deceased.

 

How could she ever obtain any tax return docs and would she be excused under these circumstances please?

she needs resdiency in the US and an income

we don't know what she has for income so hard to answer

Unsure but her exhubands income would not be considered hers even if divorce papers allowed him to keep claiming her ( alimony he paid)

If she hasn't worked, then she can submit a statement explaining that she wasn't required to file because she had no income. Otherwise, she needs to file for any of the past 3 years where she had income above the minimum threshold required by the IRS to file. USCs (and LPRs) are taxed on worldwide income.

 

Note that she will need US domicile, or show sufficient intent to establish US domicile, before the visa can be issued.

 

If she does not have income that will remain in the US upon returning to the US nor sufficient assets (3x 125% of the poverty level for your household size) to sponsor, then she will need a joint sponsor for the I-864.

She did not work so has no income to tax. She was not required to file. Instead of a tax return, behind her I-864 she will put a signed statement saying she was not required to file a tax return because she was unemployed. It explains that in the I-864 instructions.

You can be unemployed and still need to file. Salary is not the only income. It has to be clear that she had no income.

Kris&me: Thank you. her exhusband is no longer alive so he definitely wouldn't count... we will use an affidavit, and we have purchased a house in Ohio for residency

Coco8: Thank you. That's interesting... Would you know, be there a quest of request, how far back would she be required to inquest please?

Yes, good point. If she earned over the filing threshold while not being employed, she would have to file.
