hi there!

I am filling the Affidavit of support to bring my mother as a permanent resident. I do not meet the income required so we are using my fiance and father of my child. We live together and fill taxes as married for the past 3 years. We do not have a marriage certificated tho. Can I list him as "HUSBAND"? DOMESTIC PARTNER? FIANCE? WHAT IS the proper name at filling the forms?

Please clarify...

Are you a US citizen? Are you in fact married? If not, then you are classified as single. 

 

Note: If you are not technically married but filing married in your taxes that could be an issue.

 

2nd note: Be aware that health insurance for your mother should be investigated now while you have time because the high cost seem to keep catching families in the US off guard once their parents get here.

1. What is your status here in the USA?

2. Why are you filing taxes as married? Are you two considered as a married couple in the US?

3.  You can only list him as husband if you are married. You can only list him as domestic partner if you have registered him as your domestic partner.

 

Listing him as a fiance (but filing jointly as married) is a big issue I believe...?

if you aren't legally married, than you can't file taxes as married, so you will need to amend your taxes in the first place, and probably pay back what was given to you as a married couple, you are single as long as you aren't legally married

 

once the taxes are corrected your fiancé will have to be your joint sponsor, since you aren't married and you don't have a marriage certificate to prove it, he will be your joint sponsor and not co sponsor. you won't be able to combine income,  he will have to have income to cover 2 people, himself and your mom
