My spouse and I are currently going through the same process as my spouse does not meet the minimum residency requirements either (he is dual too).

Just to give you a heads up my son's i130 petition was approved 1 month before mine. It took some effort to link the files up but were able to by talking to Tier 2 at USCIS.

Upon point of entry with your child's green card they will become a US citizen. Once you have the stamp you can take it to the US Passport office to get one for your child which would then prove citizenship. It's cheaper than the N-600 route which costs about $600 for the certificate.

So you're not able to get CRBA's approval for your child's us citizenship? Are u in USA now?

how long dis you process the whole thing? From filing the i-30 to visa approved?

Do you mean reporting the birth abroad? It may be an option (I doubt it is because my spouse has not resided in the US as an adult until now). I thought since I was getting my spousal Visa I thought I would get my son a Visa at the same time. We are both residing outside the US while my spouse is currently living there.

If you decide to complete the entire process abroad it takes on average 12-14 months from the time you start to finish. I have been able to visit my spouse every 7 weeks or so for a duration of about 10 days. It's up to the border agent though as to whether they will allow you to visit, for how long or if at all. You have to show ties and proof you will return after the visit is over. If you decide to go this route I would advise getting a tourist Visa before you start as it's very difficult to get one after you apply for an immigrant visa.

I mean. How long is the i-130 process. My husband will be the one to file it and send it in chicago lockbox where he is currently living.

For the spouse or child of a USC, roughly 12-14 months on average right now.

The i130 process is one of 3 steps that you have to go through in order to complete your Visa. First you complete the i130 and once it gets approved then it gets forwarded to the National Visa Center and then after that is completed to your local Consulate. The i130 does not grant immigration status and you must complete the 2 other steps before you can legally move (the process ends with an interview at your Consulate). The i130 can vary depending on what service center it is sent to. It can take anywhere from 5-10 months depending on where it goes. But as mentioned by myself and others the whole process takes 12-14 months.
