I'm not sure if I asked this yet, but I was wanting to get feedback. I submitted an "Out of Normal Processing Time" inquiry on 11/02 and received a response via email on 11/28 that my case is being reviewed by and office and to allow 60 days for an answer. Well, being as impatient as I am now with my one year mark coming up in a couple of days, would it be necessary to put in a request for my Congressman to reach out to USCIS on my behalf? Or should I just ride out the remaining 31 days since I received that email response and hope for an answer?

Crysta if your Email says your case is being reviewed then it means an officer is looking at your case and is doing your background. Give it a few more days and I bet your going to get approval any day now..

I know it’s really hard waiting and waiting but your Day is coming...

Thank you Sundee. I've been telling myself that too since I've started getting the urge to get my congressman involved but kept putting it off. I'm going to continue to wait! <3

From my own personal experience and I went to both Congressman and both state senator's they don't care, they don't push anything on your behave, they only do the same thing you and I do, we just hope that if they do it, it might hold more merit but honestly it is nothing but a waste of time they do not help, well at least in my case they were uncaring and really unresponsive.

Thank you Khallaf and Sundee. I knew the voice in my head (being in Nebraska made me have little angry impatient voices in my head lol) was telling me to just wait and I just wanted someone else to tell me the same thing. LOL. Oooooh Nebraska you Hell whole making me go nuts!! LOL

I went to my congress, and state senator when the voice in my head went nuts to, they only made it worse..but those with actual medical related problems should try everything. I tried to expedite due to the number of terrorist activity in Egypt.

So I had my Interview today - 

 

It went quite well - probably lasted between 3 & 5 minutes. The usual basic questions and when it ended, she said all looks good so far but they will have to wait for my medicals before making a decision (I only did my medicals exactly last week and since then, it's been holidays, work only resumed in Jamaica yesterday). In Jamaica, the hospital sends the medicals directly to the Consular office.

 

She didn't ask to see any supporting documents or any proof of relationship evidence, not even a single picture (I had so many supporting documents - I just wasted time and energy gathering them :angry:). She has all the pictures and the supporting documents I sent with the I-130 Petition and she glanced through few of them as she was interviewing me.

 

Hopefully before the end of next week they should have my medicals and then, I will see how it goes.

 

So my interview didn't get that super climax feeling like most people here, I will have to wait a bit more for that :(

 

My current status on CEAC is "Administrative Processing".

We all have been patiently waiting are turn.  The wait is torcher. You can only take some much.  Soon it will be over.

Frustrating process indeed, 374 days for us. We’re in the same spot as you are, case is with an officer, allow 60 days. We did go to a Congressman whom we had to fax (yes, fax) their form (twice as the first facsimile didn’t reach them... sigh), only receiving a note that they will inquire on our behalf. So far no word from them. Jan/19 is the 60 day mark from our inquiry to USCIS. I say try anything you can, better than this endless wait.

This has probably been asked but I need to know this. Now that tax year is coming up, how do I file my taxes, married filing separately, jointly or as head of household since my husband is not having SSN no. and I don’t want to go through all that to get him an SSN for tax purposes. Thanks

Assuming you are a resident alien, US citizen or permanent resident, the information below applies to you. If you are neither of those or are not sure, please post back with your visa status and time in the US.

 

 

Filing a tax return with a non-resident alien spouse

 

If a person is not a US citizen, permanent resident or resident alien, they are considered a non-resident alien.

There are several reasons why someone is a non-resident alien.

•         They live abroad

•         They were in the US but don’t meet the Substantial Presence Test

•         They are in the US but are an exempt individual (J, Q, F, M, A, G visa holders meeting certain conditions, see http://www.irs.gov/Individuals/International-Taxpayers/The-Green-Card-Test-and-the-Substantial-Presence-Test)

Generally, a non-resident alien (NRA) cannot file a joint return. That would mean that if you are married to a NRA, you would need to file as married filing separately or HoH if you have a qualifying child and meet the HoH requirements.

Filing married filing separately requires providing the SSN/ITIN for your spouse. However, NRAs often do not have an ITIN/SSN. If they are not required to get an ITIN (meaning they are not required to file a US tax return), you can file without it and write “NRA” in the field for the ITIN/SSN.  Note however, that you wont be able to e-file doing this.

If the NRA spouse has no US source income, the other spouse can also take an exemption for the NRA spouse on a married filing separately return. In order to do this, the NRA spouse needs to apply for an ITIN if they don’t have an SSN/ITIN.

Another option is to file married filing jointly. Since an NRA can not do that, both spouses need to sign a statement that they both choose to treat the NRA spouse as a resident alien for the entire year. This allows them to file jointly. The choice is valid for any following year unless suspended or revoked.

Treating the NRA spouse as resident alien means that they are required to report worldwide income. If they have foreign earned income, they might be able to use the foreign earned income exclusion on form 2555(if the meet either the bona fide residency or physical presence test) and/or use the foreign paid tax credit on form 1116.

Filing jointly will also require the NRA spouse treated as resident alien for tax purposes to have an SSN or ITIN.

Thank you for your  response. I am a US citizen and we have a son together who is 6mths.  In that case will it be HOH since he’s not having any US income? Thanks

Today I received my REQUEST FOR EVIDENCE letter. USCIS is asking for  a translation of our marriage certificate. I have a professional translation, I sent this in the original package, or at least I thought I did. I am now second guessing myself. In any event, I will resend it immediately. I am glad that this was an easy request. Now I wait longer for our approval and our day we will be together .... we pray the wait will not be long.
