My husband Francisco (27yrs) and I, have recently gone through the immigration process to obtain his greencard. We filed all the appropriate applications, worked with an immigration lawyer, and followed all of the steps required. In March 2017, we received a notice that his application had been received and would be under review. The months following, we received notice that his appointment in Juarez would be in exactly four weeks, 9/4/17. My husband traveled to Juarez, and at his medical exam, admitted to trying marijuana in his life. At the ‘interview’ appointment, he did not get an interview, they flat out told him that his application had been denied. They informed him at the consulate that he will be barred for one year and is eligible to reapply 9/1/18. 

 

Has anyone been or know of anyone, that has been through / in this situation? Looking for some help and guidance as to what the ‘next’ steps would be. I would greatly appreciate, any and all information. That would be so incredibly helpful. Thanks so much!

Hi Andrienne,

 

I'm really sorry to hear about your husband being denied (INA 212(a)(1)(A)(iv) ineligibility) despite the consulate not interviewing him. Please look at the topic below for a very similar case. There is a lot of hope that your husband will be at Juarez after one year. This same individual went through same situation and at the end, he received his visa approval.

As noted, he was deemed inadmissible due to the past drug use. After the year has passed, he can proceed with the case. He will need a new medical and new police certificate(s) as they will have expired by then.
