Hello I'm new to this forum and have a few questions about the I-130.

I am getting ready to marry a beautfiul Colombian woman this weekend. We are completing all of the necessary forms for the K-3 visa so that we can immediately begin the process. I have the I-130 form completed, but I am confused about question 15. Are they asking for my employer or my wife's? Also, I am in the military, so if they are asking for my employer should I just put U.S. Army and my duty station? Or should I write in my unit address?

One more question. I will be deploying shortly after I return from Colombia. So when she enters the United States she is going to live with my sister until I return. How long can she stay in the US with the K-3 visa before she needs to apply for a change of status? I ask this because I will not be returning home until after our one year anniversary, and from what I have read I believe I need to be with her for an interview. I've read quite a bit about the immigration process, but my mind is so boggled right now with trying to square everything away in such a short amount of time and preparing to leave.

Question 15 is in the section titled "C. Information about your relative." Section C has to do with the benificiary Your Spouse.

K-3 visas have up to 2 years before needing to adjust status, she can apply for EAD in the meantime to at least get a SSN and Work. Some people on the (K-3) wait until just before their 2nd wedding anniversary to file AOS, to avoid the conditional status green card, and the future need to then lift the conditions.

K-3 is also a multi-entry visa so she could travel out of the country and re-enter on that visa.

Yes, question #15 is for the beneficiary. I got confused and put my employment info in there by mistake, so I'm hoping they catch it by comparing it to the G-325A.

Also, why are you filing for a K-3 since you'll be gone when she gets back? Have you thought about the CR-1 option? Right now we're looking at an average of about 7-9 months for those visas to be processed via Bogotá. Just a thought.

One last thing, make sure you read the Colombian threads we have going on here on VJ, they are filled with very helpful info that you might need down the road.

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Question # 15 is asking for your wife's (Your relative, The beneficiary) employment information.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

I wish I would have found this site months ago.

After you marry and then you come back to the US, you have to file I-130 first and wait for the Notice of Action before you file K-3. (that is if you don't know)
