I-485 Receipt

So in order to show residency in the State of California for tuition purposes at SDSU, I'm having to appeal their rejection. They say she's not because her green card was issued in Feb of this year and I say she is because she case to live here for not-school and her visa doesn't prevent her from forming a home here (actually a requirement for her to get a green card in the first place).

 

 

... So the question is... What document can I show that shows the acceptance of the AOS i-485? I can't remember what documents were given to us....is there any way to retrieve these documents from the government if we don't have a copy of them? (we did save them but we put them so safely away we can't remember where they are lol)

Residency can start when your spouse was issued the EAD I believe...

You can use the EAD card or green card to show as person being a resident in California.

 

The approval of the application might also be used...this is the form I-797 of the AOS or EAD (not the I-797c which is receipt notice).

If I don't have a copy of the I-797, is there any way to get the copy elsewhere?

I don't know. It is always a hard copy...you can try calling USCIS to ask if they can send a copy of it or advice you what to do. Do you still remember the case number of your application?

What I did is go to the USCIS website with my case numbers and I was able to get all the history on my account even though the process had finished. I used that as backup, we'll see if it's enough. I tried called USCIS but that was a wasted  45 minutes fiddling with the phone robot lol
