Hello,

I have submitted the petition for the I-130 for my foreign spouse and now the waiting has begun.  He is living in his country and I am in the USA while we are waiting for his approval.

 

He already has a tourist visa for the USA, could he come to the USA for a two week visit while we are waiting for the approval of his case.  I don't have any vacation days to visit him.

 

Has anyone else had their foreign spouse visit them while the I-130 was processing.  Is there a risk that they are not allowed entry into the USA because the I-130 is pending.  Also, could the visit to the USA affect the I-130 process in any way, we wouldn't want to risk any problems or delay in the processing. But one year is a very long time to be apart while we are waiting for this to process.

i've applied in january and traveled up until may to the US with an ESTA, no issues at all. Just be truthful when they ask questions, because they will.

I have made several trips to the US with I-130 pending. I am presently in the US  on vacay and I arrive after my approval and also after NVC received my case. I had no issues on any of my trips.  I am hopeful that this is my last trip as a visitor.

Visa - CR1

Service Center - Nebraska

PD - January 26, 2017

NOA1 - January 31, 2017

NOA2 - November 3, 2017

State Department - Sent November 7, 2017

NVC Received - November 9, 2017

Consular Interview - January 5, 2018

Port of Entry - Miami on January 19, 2018

 

ROC Mailed - December 14, 2019

ROC Rec'd - December 16, 2019

E-Notification - December 19, 2019

ROC sent to National Benefits Center (MSC receipt #)

Cheque cashed December 20, 2019

Ready to Schedule for interview - October 7, 2020

No ROC interview

New card is being produced - August 16, 2021
Card received - August 23, 2021

 

 

N400 -  Online

Filed - July 19, 2021
NOA - July 24, 2021

Biometrics - August 16, 2021
Interview - December 14, 2021

Approval - January 27, 2021

Oath Ceremony Notice Mailed - March 17, 2022
