Has anyone ever had the I-601 waiver approved?

I-601s are taking a long time to process, so just be prepared for that.  Some say you need a lawyer, some have done fine without.  We've submitted ours without a lawyer but we don't have any response yet so I can't say if that was a good choice yet or not.  It's hard to get clear info on the I-601.  Most info is the I-601a, and anything relating to unlawful presence.  I struggled to find CIMT info.  There are some really good tips on building a packet at http://discuss.ilw.com/showthread.php?27181-APPROVED-sample-letters-illustrating-extreme-hardship-under-I-601  and

There is a post in the second link that has a tip sheet on evidence/arguments that I've seen in several places.   Best luck to you!

yes thats what its looking like i feel like just subbmitting the waiver with them since they are not charging me to submit the waitver only the waiver fee. I feel like they owe me that since we have already paid them $6k.

You might be able to sue them for your money or some of it..But if i were you, i wouldn't trust them with waiver.

They might not have done waivers before.

Thank you everone for the responses! We are just so confused becasuse we have had other lawyers second opinion and they all seem to be on the same page about my husband not needing the I-601 waiver however we decided to just go through with it. We are just worried it could be denied. What are the chances of it being denied after the I-601A waiver has been approved?

Crime- Felony for receiving stolen property then reduced to a misdemeanor 3 years later after completing 3 year probation. My husband did a total of 29 days in jail.

Can you tell me if his sentenced was reduced after he did the probation or before? My husband had a felony for a weapon but it was reduced to a misdemeanor while he remained in jail. He was only in jail for 60 days and released as his sentenced was reduced to misdemeanor and he was given a 3 year probation but did not have to report to anyone simply could not get into any problems. I was told we simply have to provide proof of that case and during his interview he needs to let the officer at the consulate know that it was a petty crime which the sentenced for petty crimes is less than a year sentence which would not constitute to a denial of the visa.

Did your husband mention that to the officer at the time of the interview?

My husband was in jail for 29 days, then we bailed him out and a month later he agreed to a deal of 3 years probation then the felony will come down to a misdemeanor. During his interview he explained the case to the interview officer however he didn't mention it was a petty theft he only explained (3 years probation then the felony will come down to a misdemeanor). Then thats when they placed him on 221G administartive processing.

I have been reading alot and I noticed in the consular site it states that the applicant must present the statute that applies for any jail or convictions. This is why I have the law that pardons certain forms of misdemeanors and applies to my husbands case. I swear some attorneys just take our money and run. I have been doing everything myself for the I-130 to the I-601A and so far so good. Every attorney I spoke with would scare me and say that the waiver was a hard one to get approved and look here we are waiting for an interview now.  I wish you luck and all will be fine once you submit the other waiver.

Did you provide court documents that explain that the case is a misdemeanor? I am asking because how are you sure that they actually dropped his charges.
