K1 Visa Affidavit of Support Question

Timeline

Hello, I mailed my K1 petition a week ago to the Dallas Lockbox. I am waiting to hear from them that it is in processing. My question is in relation to financial support. I am currently a full time college student using my Post-911 Gi bill benefits for my education. I get a housing allowance stipend every month that I attend school. Its more than enough to cover my expenses so I only work part time (about 20 hours per week). So right now my tax return will only say i made about 15000 for this year. I currently live with my father and step mother while I am pursuing my BS in Biology. I have plans to go on to Medical School. My Father and Step mother have a combined income over 70k yearly and have agreed to offer support for our petition. Does my step mom fill this out? She has the highest earnings. Do both parents need to fill this out? Does it need to be the 134? Are most petitions with this support coming from a third party denied or approved based on anyone's knowledge? Its a very confusing process and as one can imagine I am concerned. Any help that can be provided would be appreciated thank you.

NOTE: This is specific to London K1 interviews and is not meant to be information to those going through other consulates.

 

Your fiancé will take to the London interview:

  • I-134 filled out by Mom. She will be the sponsor. (Or use Dad instead)
  • An employer letter stating her position and income.
  • Optional-- something else that shows her income like photocopies of  recent pay slips or her 2017 W2 which she will get in January.

Her joint tax return is not needed.

The above will easily be approved.

You do not have to do an I-134 because your income does not exceed around $20k which is required to be sponsor. 

 

 

Additional info for further down the road: When your new spouse files for adjustment of status, there is a different affidavit of support with more specific rules. You will fill out one of those I-864s even if you don't have enough income. Your Mom will fill out one as well as a joint sponsor. Tax returns from both will be required. Tackle that documentation when the time comes. It will also be approved.

but you need to do the 1-134 even if you are not the sponsor, the petitioner always need to send this form.

The US fiancé does not do an I-134 for London if they don't qualify on income. It may be different at other consulates. London just wants one sponsor who qualifies and it does not have to be the fiancé. They will even allow the UK fiance to sponsor himself if he has a sizable amount of cash saved up. Then there is no I-134.

Yup, as stated above.

 

If this were an immigrant visa case where an I-864 was required, then the petitioner submitting an I-864 is required. And most embassies want one from the petitioner anyway, but it is not a strict requirement so it varies from embassy to embassy (i.e. Manila very rarely even asks for an I-134).
