Good morning everyone,

Please I need your advice  :D

 

We received our NOA2 November 4th, 2017 and NVC has not received our case yet, but I am trying to gather the information my fiancé will need at the embassy for the interview as I have someone that is traveling to Nigeria by the end of this month that can help me deliver it to him. Do you think it is too early to fill out the I-134 and date it for the end of this month or I should wait till NVC processes the case.

Also, in the form there is a question on the form No. 38 that asks if "I do" or "I do not" intend to make specific contributions to support the beneficiary, please how can I respond to that as he will staying with me till he gets a job.

No it's not too early. All NVC is going to do is assign a case# and off your petition goes to Lagos. You will be doing the rest.

Well I hope you plan to contribute so it's I do.

 

What do you mean, "please how can I respond to that as he will staying with me till he gets a job"? Aren't you getting married and filing for Adjustment of status? Where is he going after he gets a job? I ask because this kind of language can get you in trouble o.

That was my thought too.  Reading it literally would mean that once he gets a job they won't be together anymore!

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Oh no thank you for helping me catch that. I meant to say providing financial support to him until he gets a job because the I-134 is asking to be specific as to the amount or how you intend to provide support and the duration for the support.

Thank you, I apologize the misunderstanding. I meant to say "providing financial support until he gets a job".

All you have to do is show that you meet the minimum AND convince the CO the same.  Some people over the minimum are not approved while occasionally people at the minimum are.  If you can show that the beneficiary will not be a public charge and the CO agrees you are good to go.  That is their main concern.  A beneficiary coming to America and ending up as a public charge.

This article about form I-134 Affidavit of Support might help you answer your question. It says you can skip that question (note that that article refers to the old version of form I-134, but question 11 that the article refers to is exactly the same one as question 38 in the new form). On the book about Fiancé & Marriage Visas by the same author, she gives an explanation as why not to answer this question: "This is only for visitors that are truly temporary, such as tourists". Hope it helps.
