Green card for LPR husband's son

Hi there. I'm currently sponsoring my husband for a green card. We already received the EAD combo card. Once he has his green card he would like to sponsor his son for a green card. He is under 21 and won't be 21 in 2-3 years which I believe the visa process will take for him.

 

I didn't adopt him. He lives with his mother in my husband's home country. My husband is mentioned as the father in the child's birth certificate. When they got divorced they didn't decide anything on custody. Does my husband have to have full custody or is it sufficient if we get the mother's permission to apply for the child's green card?

did you marry your husband before or after he turned 18?

 

since he will be over 18, he won't need permission from his mom

 

now what relationship does he have with his son? I don't think he would want to come and live with strangers if his father hasn't been in his life

Either.

 

The obvious easier one would be legal written permission from the mother.
