Hi folks!

 

Just got a couple of questions regarding the I-864 application.

 

1) Part 3, Line 1 says "I am sponsoring the Principal Applicant in Part 2. Do I put Yes? 

 

2) In Part 3, line 2 states "I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2.(Do not include any relative listed on a separate visa petition." I'm only sponsoring my wife. Do I have to check this box? Also, do I have to put in my wife's name in lines 3+ after line 2. It seems to be connected to each other. 

 

3) In part 3, line 28, it asks you to list the number of immigrants being sponsored from lines 1.a.-27. Thus far, I've put 0 since I don't think I have to write my wife down here. Is this correct? 

 

Finally 4) One of the extra requirements they ask for is this "Proof of their residency in your household and relationship to you if they are not the intending immigrants or are not listed as dependents on your Federal income tax return for the most recent tax year." I can supply our marriage certificate as proof of our relationship, however we have nothing to prove that she's living where we are in the US other than a couple pieces of mail with her name and address on them. Is this sufficient proof for this task?

1= yes   2= no she isn't coming with anyone else,  3 No, you have to write 1 because you are sponsoring your wife which is 1 person

 

4= that is only related to when you send the i864A, which is not your case. you aren't sending the i864A

Thanks for the help. But now I have a different problem

 

If I put in 1 there, that number has to be put in the total for part 5, line 8. It says to add lines 1-7 in part 5 and my wife is being double counted in my household. It says to put 1 for your spouse, which I do,  but she's also counted in line 1 of part 5 automatically from putting 1 in part 3. My household should be 3 people not 4. Thoughts?

hi

 

you don't count her as your spouse, you count her as the beneficiary when you are filing for spouse

 

you would count her as your spouse only if you were filing for someone else, such as a parent, sibling or child

you don't need to put anything, not even 0

 

you mark 1 on 1 as the beneficiary, you are already filled, if you have a child, mark 1 in child, then at the end you would put 2 if it the 2 of you or 3 if you have a child

Just for clarification: I put 1 on line 1 for my wife (beneficiary). I put 1 in line 2 for myself, and 1 for my child in 4 for a total of 3. Does that sound right?

Hi everyone.

 

Thanks for the boat loads of help that this place provides. I can't imagine doing this back before the internet. I've just assembled my I-864 application and supporting documents, but have a couple of questions.

 

1) Do I need to provide a letter from my bank stating how much money i've put into the account etc... or would a copy of my current balance from the webpage suffice?

 

2) Since my wife isn't on my most recent federal tax returns, I need to prove that she resides at our residence and prove our relation to each other. To do this, I'm providing USCIS with a copy of our marriage certificate to show we're married and 2 copies of mail with our local address and her name on them. Is this fine? 

 

3) Is it beneficial to provide statements from my 401k plan? 

 

Thank you again for the information. I look forward to helping people out in the future based on my experience.
