I did the k1 visa for my fiancé but it got refused do to something in his court records . I was able to see him over a month ago in his country and now I find out that I am pregnant by him . I am preparing the 601 waiver with a lawyer but I’m scared the waivers take so long and he won’t be able to be with me for the child’s birth. Does me being pregnant willeffect any how the waiver to make it come out sooner ?

No, pregrancy does not give you any expedite or benefit or slow-down. It does not affect anything. If the waiver takes a long time to process then he won't be able to be in the USA when you give birth.

 Hey how long did it take for them to deny the visa after he submitted the court documents for his arrest?

It took a little over a month For them to let me know via email that the visa was refused but they did tell me that he qualify for a waiver .

i see, my fiance has 2 petty theft arrests.. and he submitted his court documents 15 days ago.

My fiancé has one petty theft and it was refused . If you don’t hear anything from them in 3 weeks you can contact them and ask for the status of the decision . It will also make a difference how the petty theft is penalized in his country . Here in USA I believe it’s 6 months but In my fiancé’s country petty theft is penalized with 6 months to 3 years in jail that’s why they required a waiver .

Yeah, thats why I have been so stressed out.  It would be nice for the people that get denied to know right away instead of waiting a long time and then receiving bad news. :(

Oh yes it’s very hard trust me I know how you feel . I guess they take their time to debate weather to grant the visa or not or if the person qualifies for a waiver . My fiancé was never in jail he has to pay a fine and was let go but still since it was in his records that he was involved in that it was denied . 😞 but we are working on the waiver now with the help of ge lawyer . There is always hope .

It may be out of this topic, but it would be nice if people don't steal at all so you don't have to wait for the "bad news".

I totally agree with you but everyone makes mistakes and at that time my fiancé didn’t know me I can guarantee if he did he would had never been involved in that stupid situation .

Just FYI ask your fiancé what was the disposition of the case and also if it was consider a felony or not , maybe in his country petty theft is not penalized so harsh and it won’t really count against him and they will grant him the visa .

It is good for you to join VJ because you will have support. Unfortuantely, your husband will not be around for the birth of your child.  I am going to be realistic with you, and it will take a long time!  2 years for a waiver to be approved.  Just understand what you are up against and know that eventually, he will make it here.  Unfortuantely, Petty theft is considered a CIMT.  but if it is a simple crime, his waiver will be approved just it will take a long time and the gov does not care if you are pregnant or not.  so just prepare yourself to be raising the kid and alone for 2 years.
