And be careful, she can put you not only in financial troubles but in legal too if she already plays against the law. Cut all ties with her, you never know what she can do or say in the future if you don't divorce or better get the annulment by fraud, she could make you responsible for some other fraud

It has more to do with the laws of the state than the judge. Nothing is 100 percent but I would really like to know what state (or judge) will refuse an annulment where your spouse chooses to not live with you and you have never had physical relations. Not to mention the other factors in this case.

Both. Nothing is sure but anyways he will get at least the divorce. And yes, he has all the grounds but better the evidence IN WRITING. Start chatting with her in text or Facebook and get the screenshots of what she is saying

Eh, this is particularly hard to do successfully.  The government is relying on the US citizen to be the screener.  Some of them are better at it than others.

Come on man, go with her to the AOS and as soon you get there and sworn then tell the IO that you want to withdraw the I-864 and in front of her tell the truth to the Immigration Officer, not even a  VAWA petition, later on, will be approved!

They do not have a interview scheduled yet, he's just assuming there will be one. It's best to withdraw the I-864 now before she gets the GC in the mail.

Oh ok,I thought USCIS schedulled the  AOS interview, then  definitely  he should  withdraw asap.

He made it sound like they had an interview. It took a few times of asking him before he clarified they did not.

If so, this is what I would do.  I would show up to the interview with a notarized letter formally pulling the affidavit of support and I would let her open her mouth and lie.  Then, I'd hand the letter to the officer, describe your situation, and walk out.

 

AOS goes to checkmate and she gets a lesson in lying to USCIS.  Win/win.

US Citizens can be prosecuted for immigration fraud - if you lie under oath YOU can go to prison....I would suggest you NEVER lie when under Oath or in any government papers ( forms etc)
