Sounds like our OP was used as a means to bypass the very long wait for a petition for a sibling. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Be careful brother. She can start the process for a wawa. Don't be with her in the same room. Pull the affidavit ASAP even today, send an email to USCIS and copy the Embassy of her country on this. Sometimes, they approve the Green Card without an interview. Of course, at the 2 year expiry she will need you again with documentation so she will try and file a WAWA against you, so don't have any contact with her ever!!

Lack of consummation is not generally considered to be grounds for annulment. It depends on the State, but annulment usually involves a legal impediment to the marriage (e.g. bigamy, incest, fraud, duress, etc.).

There’s a reason behind the stereotyping though. Of course not everyone from the same country is the same but there’s a certain cultural similarity to a majority of the people from any given country.

Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received

In this instance a good cause of fraud may easily be proven.  

 

OP, I would be going for the trifecta at this point.  Write, infopass appointment and file for divorce and/or annulment.  This will assure you have all bases covered.  Make sure you get the ball rolling on all three Monday, since this next week is shortened due to the Thanksgiving holiday.  Good luck and keep us informed.

On the AOS, don't both the USC and beneficiary state they are in a honest marriage (or something to that effect?). How did you sign the I-485 then when you knew things were not up to par 100%? This might cone up if you go to the interview. Pulling the affidavit, notify USCIS etc..is the best option

By definition you are conspiring to commit benefit fraud against the Federal Government.  DANGEROUS... Don't Lie....False misrepresentation of material fact = jail. 5 years jail for YOU....Those charged with marriage fraud may also be charged with visa fraud, harboring an alien, conspiracy and making false statements. As of this moment she is guilty of marriage fraud, (A foreign national defrauded a U.S. citizen who believed the marriage was legitimate.)  If you don't turn her in 1. someone else will for sure turn you in or  2. The GOV agent will pick up on it and arrest you both - consult a lawyer , ask here at top web site... 7 bucks and you'll know what u need to know - .......One thing for sure..... if you lie at AOS you willfully (knowingly)-  commit a federal crime...

You could also contact the USCIS directly at 1-(800)-375-5283. When you speak to a live representative, you can make sure your information is properly recorded. You could also schedule an InfoPass appointment to personally meet an USCIS official to discuss the marriage sham.

Well it's extremely hard to get an annulment if it has been consummated. In this case the fact that she did not live with him, and entered into the relationship fraudulently combined with the fact that the marriage was never consummated makes an extremely strong case for annulment.

send her ### back. she played you. why should you question it? whats fair is fair, whats not is not.

Report her immediately to the NVC & US Embassy what attention was the whole time. Tell them she scammed you as soon as she touchdown here in the U.S. Don't waste time reporting her because then you will be questioned if you knew this why didn't you ever attempted to report her. 

I know there will be other's that will say they can't do anything because she's already here but they can at least have it on record that she isn't even living with you and she wants you to lie. When her time comes they know about her attentions and boot her out!!!

This is why they should screen harder at the interview. This is BS, their is real couples out there that really love each other and not able to get a visa and some ppl who are not in love and only want a GC get it so easy.  If I were you I would not let her get away, that.

it all depends of the judge and how do you make your case. The annulment has grounds, check your state the annulment application and see, consummated or not, doesn't matter, you can get the annulment by fraud, attach all chats or evidence in writing, make a latter explaining and, ask for annulment, in case the judge doesn't see enough evidence for annulment, gives you a simple divorce anyway. But as I see you can get the Annulment by Fraud
