I really need help because i search alot but no useful information so came here, i did khula and now going to get married n settle in us i m engaged now and he lives in california , soon we will get married but i m so scared does us embassy accept khula as divorce ? Bcoz i cant get divorce from my x husband and he wont help me in this . Thats why i had to take khula . But now when i searched for visa procedure its aaking for death divorce and annulment decrees all original . So want to is my khula accepetable by us embassy before i start my case i want to know.

No, you need a legal divorce certificate/decree in order to be eligible to marry and file any paperwork related to USCIS.

In order to have a successful filing, yes.  To file, no.  People file and are denied regularly.  In order to have a marriage recognized for US immigration purposes, the petitioner must demonstrate that the two of you were both free to marry prior to any marriage to each other.  In the absence of a legally recognized divorce decree, you simply are not free to marry, based on an US definition thereof.

My x wont ready to divorce me i m in pakistan and he is in uk . We got married in pakistan after that i found out of his an other divorce before and his bad behavour made me to take khula registret from union council . Because he wants me to be like this full life suffering .n i m engaged now want to settle down in usa . Seems like i m i big problem 🤦🏻‍♀️ Dont know what to do. Thank you so much for advices .

I dont know but i m here in pakistan as afghan refugee , my xhusband lives in uk we got married but never did rukhsati and i didnt get any dowery money , so i filed khula against him to get divorce , khula is divorce from woman when husband refuse to give her divorce . So in this case wife should leave her dowery money to husband and get khula . So i m doing sme here lawyers here says if i get my khula and register it to union council and foreign administration and then register it in afghan embassy then it is acceptable in any country bcoz khula is divorce from woman side. My husband stopped contacting even when i sent him notices of khula but he was married there he ignored to contact or any reaction so in this case i had no other choice to take khula n leave my haq e meher .

My wife was previously in nikkah .no rukhsati.

. My wife is also having a khula decree from family court. The decree is showing dissolution of marriage and iddat start from the same date which is announced by court.no further proceeding for union council.90 days over. Iddat completed.

 

my wife did not get certificate from council.

later on in her life i came and we happily married.

i already applied for her visa few months ago and submitted that family court decree in embassy.

Later on someone told me get a certificate from council. Which she got it few days ago. The council issued her certicate by following court decree and date of effectiveness of dissolution of marriage on it is same which is granted by court.

now i am in very confused situation

my basic question is should i send that certificate which is issued by council or wait if the embassy ask??

as already submitted family court decree.

Hi dear brother .

no my l lawyer said i dont need idaat period i can remarry next day , bcoz when i got married i had no rukhsati so i never start life as husband n wife , it was our family demand to him to first make my case n get me visa then in uk we will be together . But soon after he left to uk we found out he has a wife n kid so we ask for divorce but he disappeared n he didnt  to any notices i send him through dhl email n viber .my khula case is in procces if you want i can give you my lawyer number yoo can call him n talk to him he is advocate . I m sure you will get ur answers i realy want you n ur wife get together bcoz i know how hard it is , i recently got engaged to my cozen n i m realy concern about my khula if Us embassy accept it bcoz khula is legal divorce from woman .

its really tough apart from each other as husband and wife.

my wife situation was similar like you. She did not start her life with her ex husband.

when khula decree grant from court in pakistan iddat is also mentioned as it is announced and khula decree becomes effective on 90days(when only nikah and no rukhsati).

you can read it on last paragrapgh of your court decree.

please recomend me a good advocate or lawyer

Oh thats so sad bcoz we were planing to get married on other 2 months 😕 . Ok when i get my certificate i will know if i need idaat period or no bcoz i have asked many poeple i also found what our Rasool Allah said about khula n idaat period . But lets see whats gona happen i m sending you lawyer card hope you guys finda good n quick way .

You welcome . Yea you can tell him afghan family haji saheb gave this num . Wish you both good luck hope he help you in ur wife case . Some one told me that woman in this case should make paper in foreign ministry that she was single before marry her second husband .US embassy just want to make sure that your wife was single n terminated with her before marriage.

From what I've read, the Khula needs to be registered with the Union Council under MFLO 1961 to be accepted by the embassy.  Family Court Decree isn't enough.

 

Has anyone been successful otherwise?
