Usa tourist visa renewal with postponed CR1 case

I know the question was asked many times but I believe my situation is not very common. We have applied for CR1 visa in 2015 and I had interview appointment in early 2016. But by that time circumstances changed, I got pregnant and we decided to have baby in Ukraine and spend the first year of her life there. And after my husband got into grad school in Italy and so we postponed our move to USA again. I have a case at the embassy that is updated every 6 month when i contact them. We are still not sure when we will be ready to move back to USA.

My USA tourist visa expires in 3 month and would like to apply for new one since we have to go for my sister in law wedding in May.

Logic tells me i shouldn't have a problem to get it since i am not potential immigrant, if i wanted to immigrate i would just go for CR1 interview.

But i guess logic doesn't work that way with USA embassy.

Maybe anyone heard of such cases, i would really like to have input.

 Thank you

You are correct.  Logic does not work that way at the Consular Non-immigrant visa Unit at any Embassy or Consulate.  US law prohibits issuing a non-immigrant visa to a person with immigrant intent, even the intent is not imminent.  You might be successful and it will only cost money and time (maybe travel expense) to try.  Laws do NOT prohibit using a visa already issued, like the currently valid one you have.
