Hi everyone! My husband and I have been working hard putting all of our paperwork together for the past few weeks to adjust status, and I think we're almost ready! Here's our checklist/table of content of everything that we're filing together, and I would GREATLY appreciate any input/criticism/suggestions/missing paperwork. (I know we're a bit short on the "bona fide" marriage front, but since I've been living with him in his country for the better part of the last decade and we're still transient here in the US, I'm hoping that a billion pictures and affidavits will be sufficient. We've never even been on the same lease until now! Everything was simply in my name..)

 

1.     Personal Checks in the amounts of $85 for Biometric Services fee, $1140 for I-485 filing fee, and $535 for I-130 filing fee payable to U.S. Department of Homeland Security

2.     Form G-1145 E-Notification of application/petition acceptance

3.     I-485 Application to Register Permanent Residence or Adjust Status

  • a)     Form I-485 (Application to Adjust Status)
  • b)     Two passport-type pictures of beneficiary (placed in a small plastic bag, labeled with full name)
  • c)     Copy of beneficiary’s passport's biographical page
  • d)     Copy of Beneficiary’s Birth Certificate (in Spanish with English Translation)
  • e)     Copy of Marriage Certificate (in Spanish with English Translation)
  • f)      Copy of Inspection and Admission: Copy of passport page with valid Tourist Visa, copy of passport page with stamp of last Entry into US, and form I-94 Arrival.
  • g)     Evidence of Continuously Maintaining a Lawful Status Since Arrival in the United States: historical I-94 Arrival and Departure records.
  • h)     Two passport-type pictures of Beneficiary (placed in a small plastic bag, labeled with full name)

4.     I-131 Application for Travel Document

  • a)     Form I-131 (Application for Travel Document – Advance Parole)
  • b)     Two passport-type pictures of Beneficiary (placed in a small plastic bag, labeled with full name)
  • c)     Copy of beneficiary’s passport's biographical page
  • d)     Copy of Inspection and Admission: Copy of passport page with valid Tourist Visa, copy of passport page with stamp of last Entry into US, and form I-94 Arrival

5.     I-765 Application for Employment Authorization

  • a)     Form I-765 (Application for Employment Authorization)
  • b)     Copy of beneficiary’s passport's biographical page
  • c)     Two passport-type pictures of Beneficiary (placed in a small plastic bag, labeled with full name)

6.     I-130 Petition for Alien Relative

  • a)     Form I-130 (Petition for Alien Relative)
  • b)     Proof of Petitioner’s citizenship: Copy of all pages of US Citizen’s Passport
  • c)     Two passport-type pictures of US Citizen (placed in a small plastic bag, labeled with full name)
  • d)     Copy of Beneficiary’s Birth Certificate (in Spanish and English translation)
  • e)     Copy of Beneficiary’s Passport : Copy of passport's biographical page, copy of passport page with valid Tourist Visa, copy of passport page with stamp of last Entry into US, and form I-94 Arrival.
  • f)      Two passport-type pictures of Beneficiary (placed in a small plastic bag, labeled with full name)
  • g)     Copy of marriage certificate (in Spanish and English translation)
  • h)     Evidence of Bona fide Marriage
  1. i.               Selection of pictures that document relationship and marriage

8.     I-864 Affidavit of Support

  • a)     Form I-864 Affidavit of Support
  • b)     Copy of Petitioner’s Letter of Employment
  • c)     Copy of Petitioner’s earning statements from 2017 (**none of my previous years passed the 125% poverty line because I was working abroad, but I have  surpassed this in the months I've worked in  the US in 2017)
  • d)     Copy of 2016 Federal Tax Return and 1099 (**no W-2)

 

 

I know I HAVE to be missing something in this mountain of paperwork, but have yet to identify it, lol.

1) Did you have a medical exam by a civil surgeon yet? I am not that familiar with I-130 applications so I don't know when you are supposed to send it in but you will have to get it at some point.

 

2) I included a photocopy of the certified copy of the marriage certificate to show that we fulfilled the basis for applying for I-131 and I-765, just in case.

 

3) You don't have to specify that the pictures are in a plastic bag.

 

4) It would be great if you could get tax transcripts from IRS, either online or by mail.

 

5) You need to include the birth certificate or all the pages of the petitioner's passport to show that they are a US citizen (or LPR and relative documents) in the I-864 package.

 

6) Do you have any official mail addressed to you at your shared address? Any other evidence that shows that you live at the same address would be great. Do you have a joint bank account? Is the beneficiary's name on any of the utilities? Affidavits are really not that important as pieces of evidence. Travel itineraries, pics from trips, boarding passes, receipts showing you were where you say at the time are also good to include.
