I appreciate your response. My husband is a us citizen and am due for an interview next month.meanwhile we included her to my case while my husband was an green card holder. But she was later asked to be filed for. While checking the time line we saw that there was no enough time.so we decided to file a tourist visa for her then later the i130

They usually approve children petitions in a heart beat if the primary beneficiary  petition is approved. Even though those are separate cases, they do look at them as a whole. Send the papers for the child asap and delay your case if possible.

Mod hat off

I've seen it mentioned here many times about having to match a child's I130 to a parent. Then they will be ready together. More experienced members will help you more with this.

Make sure you do not file a tourist visa with the intent to live permanently in the US, as that would be fraud. However, it looks like you are trying to find the legal way for your child to join you. How old is the baby? Could you file for her to join you, then wait until her visa is ready? They usually give a six month window between issuing the K1 visa and it expiring. How far along are you in the process of your own visa?

I appreciate the response. Do u mean they approve i130 for children faster?  If so then it means we wud have to stay back after our interview.

Our intention isn't for her to live permanently. My hubby travels to our home country every 6 months. All we intended is for our baby to stay with us while we petition her then come back home for d consular interview.

Yes, they do it for children faster, because the children case is connected to the main beneficiary. It took 3 months to approve our i-130. I applied for my children later separately after it, and they got approved for 2 weeks. You can also postpone your interview right?

It means we have to begin the filing immediately. There's no way I think we cud postpone the interview cos medicals expire in 6 months.

You can do medicals again or just travel on your shortened visa. Write them and explain your situation. Do you really need 6 months to travel to the us? We got visa in Feb and we knew we would not travel earlier than July. We had just one month before it expired. If you sit and wonder what to do, you will run out of time. Contact them and start the process as soon as possible and send by express post.

If you cant postpone the interview, then can you leave your child behind while the process for the child get done?

Just hurry up and send the papers anyway. As option, You can also cross the border get the stamp and return back to wait together with your baby in your home country to finish the process . Just make sure your stay won't exceed 6 months
